. .... . ... ... . ..... . ?w,,,...?,. .. ,. ._. <br />CITY OF NORTH OLMSTED <br />ORDTNANCE N0. 7 8 - I7-5' <br />BY: <br />AN ORDINANCE AUT'HORIZING THF, MAYOR OF THE CITY OF NORTH <br />OLMSTED TO ENTER INTO AN AGREFMENT WITH THE BOARD OF <br />CUYAHOGA COUNTY COMMISSIONERS WHEREIN THE CTTY OF NOR'TH <br />OLMSTED IS TO SERVE AS LEAD AGENCY IN AN APPLICATION FOR <br />A FACTLITY PLAN, TO PROVIDE FACILITY PLANNING SERVICES <br />FOR OLMSTED TOWNSHIP, AND TO PERFORM OTHER NECESSARY <br />MATTERS FOR A FEDERAL GRANT UNDER THE PROVISIONS OF THE <br />WATER POLUTION CONTROL ACT AMENDNIENTS OF 1972, IN CONNECTION <br />WITH INIPROVENIENTS AND ADDITIONS TO THE WASTE4VATER TREA'1MENT <br />AND SANITARY SEWERAGE FACILITIES OF OLMSTED TOWNSHIP, AS <br />PART OF THE AREA KNOWN AS THE NORTH OLMSTED FACTLITY PLAN <br />AND DECLARING AN D'IERGENCY. <br />WHEREAS, the Federal Water Pollution Control Act Amendments of 1972 <br />(PL. 92-500) provide for grants through the U. S. Environmental Protection Agency <br />for planning (Step 1), detailed design (Step 2) and construction (Step 3) of waste <br />treatment works; and <br />WHEREAS, the City of North Olmsted is being considered as a single entity <br />for purposes of priority ranking and federal funding and did receive priority <br />number 217 on the Ohio EPA Priority List for Construction Grants dated Ma.y 25, <br />1978; and <br />WHEREAS, sections of unincorporated areas in Olmsted Township, Cuyahoga <br />County are tributary to and served by the municipal sewer systems in the City of <br />North Olmsted and to incorporate the area within the corporate limits of Fairview <br />Park in the study area for Facilities Planning (including infiltration/inflow <br />analysis and sewer system evaluation). <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUN'I'Y OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That the City of North Olmsted will participate in the <br />implementat olf-a Facilities Plan and that the Mayor be and he is hereby <br />directed to enter into an agreement with the Board of Cuyahoga County Corrmiissioners <br />in the filing of an application and other necessary matters as required to secure <br />federal grants under the Water Pollution Control Act Amendments of 1972 as the <br />initial step in developing the Facilities Plan. <br />SECTION 2: That in order to preserve the public peace, health and safety <br />and in or er to expedite the filing of the aforementioned application for federal <br />grants an emergency is hereby found to exist and this Ordinance is declared to be <br />an emergency measure and shall take effect irrunediately upon its passage and approval <br />provided it receives the affirmative vote of two-thirds of all members elected to <br />Coimcil and approval by the Mayor. <br />PASSED:? <br />ATTFST: <br />FLORENCE CAMPBELL, CLERK F COUNCIL <br />. <br />D ER , PRES OF COUNCIL <br />APP - ? ? <br />---- - ?-- <br />4 <br />BERT W.
