CITY OF NORTH OLMSTED <br />ORDINANCE N0. 78- 19'3 <br />BY: . ? <br />AN ORDINANCE EXPRESSING COOPERATION WITH THE DIRECTOR <br />OF TRANSPORTATION jvITH RESPECT TO THE ILLUMINATION OF <br />STATE ROUTE 17 BETWEEN STATE ROUTE 10 TO THE EAST <br />COOPERATION LINE, A DISTANCE OF APPROXIMATELY 2.1 <br />MILES, ALL WITHIN THE CI'I'Y OF NORTH 0114STED, AND <br />DECLARING AN IIMERGENCY, AS AMENDED. <br />kHEREAS, the public interest and safety demands the improvement of that <br />part of Brookpark Road, S.R. 17 situated in the City of North Olmsted, in the <br />County of Cuyahoga, State of Ohio, and described as follows: <br />the illwnination of the roadway using high pressure sodiwn lwninaires <br />from Lorain Road, S.R. 10, to the east corporation line, a distance <br />of approximately 2.1 miles al1 within the City of North Olmsted. <br />NOW5'I'HEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNT'Y OF CUYAHOGA, AND STAT'E OF OHIO: <br />SECTION 1: That it is declared to be in the public interest that the <br />consent o t e City be and such consent is hereby given to the Director of <br />Transportation to construct the above described improvement, in accordance with <br />plans, specifications and estimates as approved by the Director. <br />SECTION 2: That the City hereby proposes to cooperate with the State of <br />Ohio, in t e cost of the above described improvement as follows: <br />Asswne and contribute the entire cost and expense of the improvement <br />less the amount of Federal-Aid funds set aside by the <br />Director of Transportation and the Northeast Ohio Areawide Coordinating <br />Agency (NOACA) for the financing of this improvement from funds allocated <br />by the Federal Highway Administration, U.S. Department of Transportation. <br />SECTTON 3: That the Mayor of North Olmsted is hereby empowered and <br />directed on e al of the City to enter into agreements with the Director of <br />Transportation necessary to complete the planning and construction of this <br />improvement. <br />SECTION 4: That upon completian of said improvement, the City, will <br />thereafter ceep said highway open to traffic at all times, and <br />(a) Ma.intain the improvement in accordance with the provisions <br />of the statutes relating thereto and make ample financial <br />and other provisions for such maintenance; and <br />(b) Maintain the right-of-way and keep it free of obstructions <br />in a manner satisfactory to the State of Ohio, and hold <br />said right-of-way inviolate for public highway purposes <br />and permit no signs, posters, billboards, roadside stands <br />or other private installations within the right-of-way limits; <br />and <br />(c) Place and maintain all traffic control devices conforming to <br />the Ohio Manual of Unifo-rn Traffic Control Devices on the <br />improvement in compliance with the provisions of Section <br />4511.11 and xelated sections of the Ohio Revised Code. <br />(d) Regulate paxking in the following mannex; <br />Prohibit parkinq at all times.
