,?.,. <br /> ? <br />? <br />CITY OF NORTH OLMSTED <br />RESOLITTION N0. 78 /d-,f <br />BY: )Cv- oj"?? <br />A RESOLUTION EXPRESSING OPPOSITION TO OHIO REVISED <br />CODE SECTION 4511.53 WHICH ALLOWS PERSONS, EXCEPT <br />THOSE WHO ARE UNDER THE AGE OF 18 YEARS, OR NOVICE <br />OPERATORS, TO RIDE MOTORCYCLES WITHOUT WEARING <br />PROTECTIVE HEIIIETS: AND DECLARING AN EMERGENCY. <br />WHEREAS, the General Assembly of the State of Ohio has repealed regulations <br />requiring all persons who ride motorcycles to wear protective helmets; and <br />W-IEREAS, the Council has amended the Traffic Code of the City of North <br />Olmsted to conform with the amended Ohio Revised Code Section 4511.53; and <br />WHEREAS, the Council is highly concerned with the significant rise in the <br />number of fatalities and injuries from motorcycle accidents since the enactment <br />of the relaxed protective helmet reauirements; now, therefore: <br />NOW, Tf-EREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CIT'Y OF NORTH OU/ISTED, <br />COUNT'Y OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council desires to express its interest in the viability <br />of the citlzens of the State of Ohio and in protecting such citizens from potential <br />injury. <br />SECTION 2: That this Council is opposed to allowing persons to ride motorcycles <br />without protective helmets since many of the recent motorcycle fatalities could <br />have been avoided or the severity lessened by the use of a proper helmet. <br />SECTION 3: That this Council urges the General Assembly of the State of Ohio <br />to enact leglslation reauiring all persons riding motorcycles to wear protective <br />helmets in order to halt the cost to people in lost wages, in medical bills, and <br />in personal tragedy. <br />SECTION 4: That the Clerk of this Council be, and she hereby is, directed <br />to sen certi ied copies of this Resolution to the Clerk of the Ohio House of <br />Representatives, the Clerk of the Ohio Senate, State Representatives Rocco Colonna <br />and James Betts, State Senators Anthony J. Celebreeze, and Jerome Stano, and <br />Governor James Rhodes. <br />SECTION 5: That this Resolution is hereby determined to be an emergency <br />measure necessary for the immediate preservation of the public peace, health, <br />safety, and welfare of the City, and for the further reason that same affects the <br />day-to-day business of the municipality.
