- . . . ..«a5;..«..?.r ss.+. w.zwrv?k .. . ....._ .. . .._?w..w.+y . w-?:w?.w.w . ., . >......._ . . . .a . u n,A .. . . ... .. ...... . . . ,..,r?. ... . .. ? . . ..... _. . . ... . . ,. ,._..._ . <br />CITY OF NORTH OLTISTED <br />ORDINANCE N0. 78- /W <br />BY : j? <br />AN ORDINANCE AP-1ENDING SECTION 311.06 ENTITLED <br />"PLAY STREETS" OF CHAPTER 311 OF THE CODIFIED <br />ORDINANCES OF TE-IE CITY OF NORTH OLMSTED ENTITLED <br />"STREET OBSTRUCTIONS AND SPECIAL USES". <br />WHEREAS, the Council of the City of North Olmsted has determined that <br />Section 311.06 of the Codified Ordinances dealing with play streets is no <br />longer a necessary provision of the Traffic Code, however, it is the desire <br />of this Council to amend said Section to make provisions for the closing off <br />of streets for the purpose of having neighborhood parties,often referred to <br />as "Block Parties". <br />NOW, THEREFORF, BE IT ORDAINED BY THE COUNCIL OF Tf-IE CITY OF NORTH OLNISTED, <br />COiJNI'Y OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 311.06 of the Codified Ordinances of the City <br />of Nort Olmste entitled "Play Streets" now reading as follows: <br />"311.06 PLAY STREETS <br />Whenever authorized signs are erected indicating any street or <br />part thereof as a play street, no person shall drive a vehicle <br />upon any such street or portion thereof except drivers of vehicles <br />having business or whose residences are within such closed area, <br />and then such drivers shall exercise the greatest care in driving <br />upon any such street or portion thereof. (Ord. 613. Passed 7-7-42.)" <br />BE IT THE SATE IS HEREBY ANIENDED AND AS 90ENDED SHALL READ AS FOLLOWS: <br />311.06 BLOCK PARTIES <br />Any homeowners group, association, or representatives of a <br />neighborhood shall be nermitted to have a residential street <br />closed off to vehicular traffic for the purpose of having a <br />neighborhood party,often referred to as a"block party", provided <br />that said homeowners group, association, or representatives shall <br />first obtain a permit therefor from the Director of Public Safety <br />and in no event shall the Safety Director issue a permit with less <br />than forty-eight (48) hours advanced notice. <br />SECTION 2: That Section 311.06 as previously adopted and any other ordinance <br />or parts of ordinances in conflict herewith are hereby repealed. <br />SECTION 3: That this Ordinance shall take effect and be in force from and <br />after t e? ea est period allowed by law. <br />PASSED: 02,1, 197 ? <br />ATTEST : <br />FLORENCE CAMMPBELL, CLE OF COUNCIL <br />APPROVED : //- Z ? ? 7 1/ <br />ROBERT W.
