CITY OF NORTH 0114.STED <br />ORDINANCE N0. 78 -/ 3 0 <br />BY:?jI.?. <br />? <br />AN ORDINANCE ACCEPTING EAS04ENTS FROb7 VARIOUS <br />INDIVIDUALS IN CONNECTION WITH THE CONSTRUCTION <br />OF THE PORTER ROAD STORM WATER CULVERT. <br />WfEREAS, the City has determined that the Porter Road storm culvert <br />is in need of repair and replacement, and <br />tiUf-IEREAS, the City Engineer has advised the Council that additional <br />easements are needed to complete said project and that it is in the best interest <br />of the City to accept additional easements with respect to said project, and <br />WI-EREAS, the City Engineer has advised the Council that additional <br />easements are needed to complete said project and that it is in the best interest <br />of the City to accept additional easements with respect to said project, and <br />WfEREAS, it is the desire of the City of North Olmsted and the follow- <br />ing individuals, Eleanor Krause (Permanent Parcel Nos. 235-12-49, 235-12-50, <br />and 235-12-51), Eleanor Hansen and Kathy Diessling (Permanent Parcel Nos. <br />235-11-63, 235-11-64) to have the City's rights in said culvert project clearly <br />specified and made a matter of record by recording a formal easement, and <br />WHEREAS, this Council deems it to be in the best interest of the City <br />of North Olmsted to accept said easement. <br />NOtN, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOG.4, AND STATE OF OHIO: <br />SECTION l: That this Council does hereby accept easements from <br />Eleanor Krause, Eleanor Hansen and Kathy Diessling, for the construction and <br />maintenance of a storm drainage culvert under and on the property described in <br />said easements which are attached hereto and marked Exhibit "A" and made a part <br />hereof as though fully rewritten herein. <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby <br />directed to cause said easements to be recorded in the Office of the Recorder <br />of Cuyahoga Colmty. <br />SEC'T'ION 3: That this Ordinance shall take effect and be in force from <br />and after the earliest period allowed by law. <br />PASSED : &44,, 3 , /9 7e- <br />-T <br />ATTEST: <br />???? ? • ? , <br />FLORENCE CANIPBELL, GI,ERK OF COUNCIL <br />,. . <br />I NT CO L <br />1,TEY ERAP, <br />g11.4a z: ,d.? .
