( ? ?,. <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 78-1/0 <br />BY??.???ik?? <br />,jo <br />AN ORDINANCE PROVIDING FOR TfE SUBMISSION TO THE <br />ELECTORS OF THE CITY OF NORTH OUZSTED OF A PROPOSED <br />Al`4ENDDENT TO THE CHARTER OF THE CITY OF NORTH OLMSTED <br />RELATING TO PUBLTC BIDDING, AND DECLARINC AN IIMERGENCY. <br />WHEREAS, pursuant to the Charter of the City and the Constitution of the <br />State of Ohio, this Council has determined to authorize and direct the submission <br />to the electors of the City of North Olmsted of the proposed Charter Amendment <br />hereinafter set forth, at the General Election to be held on November 7, 1978, <br />which election is not less than sixty (60) nor more than (Jne Hundred Twenty <br />(120) days from the date of passage of this Ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY TIIE COUNCIL OF THE CITY OF NORTH 0114STED, <br />CUYAHOGA COiJNI'Y, OHIO, TWO-THIRDS OF ALL ND31BERS CONCURRING: <br />SECTION l: That this Council hereby authorizes and directs the submission <br />to the electors of the City of North Olmsted at the General Election to be held <br />at the usual places of voting in said City on Tuesday, November 7, 1978, the <br />following proposal to amend the Charter of the City of North Olmsted: <br />PROPOSAL: That Section 6 of Article VIII of the Charter be amended to <br />establis t e amount authorized to be expended without public bidding as that <br />provided for by General Law established by the General Assembly of the State of <br />Ohio, such amended Section 6 of Article VIII to read as follows: <br />"ARTICLE VIII <br />SF.CTION 6: Public Bidding <br />The Council may authorize expenditure of funds of the City in <br />amounts exceeding those provided for from time to time by the <br />general laws of the State of Ohio governing municipal corpora- <br />tions without public bidding for the acauisition of real estate, <br />for the discharge of non-contractural claims against the City, <br />for personal services, for the joint use of facilities or <br />exercise of powers with other political subdivisions, or for <br />the product or services of public utilities (including those <br />municipally operated), but no other expenditure of more than <br />that provided for from time to time by the general laws of the <br />state of Ohio governing municipal corporations shall be ma.de <br />except pursuant to contract made with the lowest and best <br />bidder after public advertising and receipt of bids in the <br />manner provided by ordinance." <br />SECTION 2: That if such amendment is approved by a majority of the electors <br />voting t ereon at such election, it shall become effective from and after the <br />time of its approval by the electors. <br />SECTION 3: That the Clerk of Council is hereby authroized and directed to <br />cause a copy of the proposed Charter amendment to be published in such manner <br />as may be authorized by law. <br />SECTION 4: That the Clerk of this Council be and he is hereby authorized <br />and directe to forward a certified copy of this Ordinance to the Board of <br />Elections of Cuyahoga County.
