CITY OF NORTH OLMSTED ORDINANCE N0. 78-1/0 BY??.???ik?? ,jo AN ORDINANCE PROVIDING FOR TfE SUBMISSION TO THE ELECTORS OF THE CITY OF NORTH OUZSTED OF A PROPOSED Al`4ENDDENT TO THE CHARTER OF THE CITY OF NORTH OLMSTED RELATING TO PUBLTC BIDDING, AND DECLARINC AN IIMERGENCY. WHEREAS, pursuant to the Charter of the City and the Constitution of the State of Ohio, this Council has determined to authorize and direct the submission to the electors of the City of North Olmsted of the proposed Charter Amendment hereinafter set forth, at the General Election to be held on November 7, 1978, which election is not less than sixty (60) nor more than (Jne Hundred Twenty (120) days from the date of passage of this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY TIIE COUNCIL OF THE CITY OF NORTH 0114STED, CUYAHOGA COiJNI'Y, OHIO, TWO-THIRDS OF ALL ND31BERS CONCURRING: SECTION l: That this Council hereby authorizes and directs the submission to the electors of the City of North Olmsted at the General Election to be held at the usual places of voting in said City on Tuesday, November 7, 1978, the following proposal to amend the Charter of the City of North Olmsted: PROPOSAL: That Section 6 of Article VIII of the Charter be amended to establis t e amount authorized to be expended without public bidding as that provided for by General Law established by the General Assembly of the State of Ohio, such amended Section 6 of Article VIII to read as follows: "ARTICLE VIII SF.CTION 6: Public Bidding The Council may authorize expenditure of funds of the City in amounts exceeding those provided for from time to time by the general laws of the State of Ohio governing municipal corpora- tions without public bidding for the acauisition of real estate, for the discharge of non-contractural claims against the City, for personal services, for the joint use of facilities or exercise of powers with other political subdivisions, or for the product or services of public utilities (including those municipally operated), but no other expenditure of more than that provided for from time to time by the general laws of the state of Ohio governing municipal corporations shall be ma.de except pursuant to contract made with the lowest and best bidder after public advertising and receipt of bids in the manner provided by ordinance." SECTION 2: That if such amendment is approved by a majority of the electors voting t ereon at such election, it shall become effective from and after the time of its approval by the electors. SECTION 3: That the Clerk of Council is hereby authroized and directed to cause a copy of the proposed Charter amendment to be published in such manner as may be authorized by law. SECTION 4: That the Clerk of this Council be and he is hereby authorized and directe to forward a certified copy of this Ordinance to the Board of Elections of Cuyahoga County.
