? <br />r t~ <br />1 w f, ? <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 78-104 <br />B Y : <br />AN ORDINANCE AMENDING SECTION 351.18 <br />OF CHAPTER 351 OF THE CODIFIED ORDIN- <br />ANCES OF THE CITY OF NORTH OLMSTED, <br />ENTITLED "PARKING GENERALLY". <br />.""k <br />IWO <br />WHEREAS, the Council of the City of North Olmsted has re- <br />viewed the waiver provisions and has determined that the fees are <br />presently inadequate, <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That Section 351.18 of the Codified Ordinances <br />of the City of North Olmsted entitled "Waiver Provisions" now <br />reading as follows: <br />"351.18 WAIVER PROVISIONS <br />(a) Whoever violates any provision of this chapter shall be <br />guilty of a misdemeanor. Any such person who has received notice to <br />appear and to answer to such violation, upon filing personally with <br />the Chief of Police at the City Hall, a written plea of guilty, <br />commonly known as a waiver, within forty-eight hours after such noti- <br />fication, Sundays or holidays excepted, may for such offense pay a <br />fine of three dollars ($3.00) without costs. If such written plea is <br />made after forty-eight hours after such notification, Sundays or <br />holidays excepted, then such violator may pay a fine of five dollars <br />($5.00), without costs. <br />(b) Notwithstanding other waiver fees contained herein, any <br />violator of Section 351.13 or 351.14 may sign a waiver and pay for <br />the first offense, fifteen dollars ($15.00), and for each subsequent <br />offense during the same winter season, not less than twenty-five <br />dollars ($25.00). <br />(c) Upon failure of a violator to appear and make such pleas <br />as aforesaid within a seventy-two hour period, a warrant may be <br />issued for the arrest of the violator and, upon conviction of the <br />offense, such violator shall be subject to the penalty provided in <br />Section 303.99 of this Traffic Code and all provisions incorporated <br />herein." <br />BE AND THE SAh1E IS HEREBY AMENDED AND AS AMENDED SHALL READ AS FOLLOWS: <br />"351.18 WAIVER PROVISIONS <br />(a) Whoever violates any provision of this chapter shall be <br />guilty of a misdemeanor. Any such person who has received notice to <br />appear and to answer to such violation, upon filing personally with <br />the Chief of Police at the City Hall, a written plea of guilty, <br />commonly known as a waiver, within forty-eight hours after such noti- <br />fication, Suday or holidays excepted, may for such offense pay a <br />fine of six dollars ($6.00) without costs. If such written plea is <br />made after forty-eight hours after such notification, Sundays or <br />holidays excepted, then such violator may pay a fine of ten dollars <br />($10.00), without costs.
