. ? .' . <br />.` <br />r..d...,.hw. <br />EASEMENT FOR THE <br />?.... ?; <br />INSTALLATION AND MAINTENANCE OF A WATER MAIN IN <br />IN THE CITY OF NORTH OLMSTED, OHIO <br />NOW ALL MEN BY THESE PRESENTS: That <br />he Grantor, herein, for valuable consideration received and to be <br />eceived to our full satisfaction, do hereby give, grant, bargain <br />nd convey to the City of North Olmsted and to the City of Cleve- <br />and, municipal corporations of the State of Ohio, the Grantees <br />erein, the perpetual right-of-way and easement, for the purpose <br />ereinafter mentioned in the following described premises, which <br />asement over premises shall be non exclusive, to wit: <br />ituated in the City of North Olmsted, County of Cuyahoga and State <br />f Ohio, and known as being part of Original Dover Township Lot No. <br />0 and bounded and described as follows: <br />eginning on the Northwesterly line of Lorain Road, 80 feet wide, <br />t its intersection with the Easterly line of said Original Lot No. <br />0 which is also the Easterly line of the City of North Olmsted; <br />hence N. 00 59' 41"W., along the Easterly line of the City of <br />orth Olmsted, a distance of 427.19 feet; <br />hence S. 890 00' 00" W., a distance of 50.00 feet; <br />hence S. 00 59' 41" E,, a distance of 456.29 feet to the North- <br />esterly line of Lorain Road; <br />Thence N. 580 47' 20" E., along the Northwesterly line of Lorain <br />Road, a distance of 34.58 feet to an angle point therein; <br />Chence N. 580 49' 36" E., along the Northwesterly line of Lorain <br />toad, a distance of 23.27 feet to the place of beginning, accord- <br />ing to a survey by The Henry G. Reitz Engineering Company, dated <br />kugust, 1977, be the same more or less but subject to all legal <br />zighways. <br />IIn consideration of the mutual covenants herein contained, the <br />Grantor hereby gives, grants and conveys unto said Grantees, the <br />right and easement to enter upon said premises and to lay, install, <br />repair, and maintain therein a water main and appurtenances, <br />including the installing and maintaining of service connections and <br />pipes, setting and maintaining all water meters and the making of <br />all repairs to mains, service meters, and all appurtenances con- <br />nected tfierewith that in the opinion of the Grantees, their <br />successors or assigns, may be necessary at any time, also to turn <br />off the water of any service or main, or to do any other thing that <br />nay be necessary or advisable i:± the judgement of said Grantees, <br />their successors or assigns, in order to maintain or operate said <br />nain, meters, connections, pipes and appurtenances in accordance <br />aith the ordinances, rules and regulations for the management and ?protection of said Grantees now in force or that may hereafter be <br />3dopted. Further, whenever maintenance or work of any kind is <br />required hereunder, the Grantees, either jointly or separately, <br />shall not be responsible for restoration of the property or its <br />environs to its original topographical condition, and should also <br />3e held blameless for any damage accruing by reason of water <br />Leakage from water mains or appurtenances, except that Grantees <br />3hall use reasonable efforts not to intensionally interfere with <br />Trantors business activity. <br />Page 1 of 5
