<br />Vienna Construction Company - Ricard P. Kadar and RoBbrt H. Bartel
<br />do hereby grant unto the City of Noi•th Olmsted, Ohio, an easement over and through
<br />the fo11owing described lands, of which said grantor(s) warrant they are the Owners
<br />in fee si.r;ple, situated in the City of North Olmsted, County of Cuyahoga and State
<br />of'Ohio, and identified by Permanen't Parcel'No.
<br />said premises having been acquired by deed dated '
<br />and recorded in Volume 222 Page '
<br />of the Cuyahoga County Record of Deeds.
<br />Situated in the City of North Olmsted, County_- of Cuyahoga and State of Ohio,
<br />and known as being the Southerly part of Sublot No. 6A in the Vienna Woods Subdivision
<br />No, lA, of part of Original Dover Township Lot No. 19, as shown by the recorded plat
<br />in Volume 222 of Maps, Page 98 of Cuyahoga County Records, said Southerly part of
<br />Sublot No. 6A has a frontage of 6.03 feet on the Easterly side of Walter Road,
<br />60 feet wide, extends back 155.07 feet on the Northerly line, 155.00 feet on the
<br />Southerly line which is also the Southerly line of Sublot No. 6A and is 1.38 feet
<br />in the rear, as appears by said plat, be the same more or less but subject to all
<br />legal highways. _

<br />The above easement is granted for_the purpose of constructing, maintaining and
<br />operating a storm drain, together with the necessary manholes, for the transportation
<br />of surface water ioith the right of unimpaired access to said storm drain the rights
<br />of ingress-and egress,--an, over--and through-said land for all purposes_necessary and_
<br />incident to the construction, operation and maintenance and from time, to time, alter,
<br />repair, or remove the same.
<br />The Grantor(s) herein reserve the right to fully use and enjoy said premises
<br />for all purposes consistent with the full use and enjoyment by the grantee of the
<br />easement herein granted. The construction of structures as defined in the Grantees
<br />Building Code, excep?- public utilities, is prohibited directly over the storn drain.
<br />Grantee shall have the right to change the size of its storm drain, the damages,
<br />if any, in making such change to Ue paid by the grantee. -
<br />After the storm drain is constructed in the above described premises, the
<br />grantee agrees to return the surface of the ground to its original elevation.
<br />The rights herein granted may be assigned in iohole or in part, and the terr.is,
<br />conditions and provisions thereof shall extend to and be binding upon the heirs,
<br />executors, administrators, personal representatives, successors and assigns, of the
<br />parties hereto.
