SHARPE <br />l <br />AN ORDINANCE AUTHORIZING AND DIRECTING THE <br />SUBMISSION OF A ZONING QUESTION TO THE <br />CUYAHOGA COUNTY BOARD OF ELECTIONS FOR THE <br />PURPOSE OF PLACING SAID QUESTION ON THE <br />JUNE 6, 1978, PRIMARY BALLOT, WHICH QUESTION <br />DEALS WITH THE REZONING OF CERTAIN LANDS FROM <br />C SINGLE RESIDENCE DISTRICT TO MULTIPLE <br />RESIDENCE DISTRICT, WHICH PROPOSAL IS MORE <br />SPECIFICALLY DESCRIBED IN ORDINANCE N0. <br />76-159 ADOPTED BY THIS COUNCIL ON JANUARY 18, <br />19773, AND DECLARING AN EMERGENCY. <br />WHEREAS, Council heretofore approved the rezoning of certain <br />lands described in Ordinance 76-159, and <br />WHEREAS, at the time said ordinance was introduced a Charter <br />provision providing for the placing of rezoning of land to multi- <br />family use had not yet been effective, and <br />WHEREAS, it is the desire of this Council to have the question <br />of rezoning, as specified in Ordinance 76-159 placed before the <br />electors for their approval or rejection. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That this Council does hereby determine that the <br />propose rezoning specified in Ordinance 1976-159, which is made <br />a part hereof and incorporated by reference, would constitute <br />additional multiple dwelling units in excess of twenty percent <br />(20%) of all dwelling units in the City of North Olmsted so as to <br />rec{uire said proposal to be referred to the electors of the City <br />of North Olmsted in compliance with Article VIT, Section 2(e). <br />SECTION 2: That this Council does hereby direct the Clerk of <br />Council, upon the approval of this Ordinance, to submit this <br />Ordinance to the Cuyahoga County Board of Elections for submission <br />to the electors at a Primary Election to be held on June 6, 1978. <br />SECTION 3: That the City Engineer is hereby directed, upon <br />the approval o this Ordinance by the majority of the electors <br />voting thereon, to cause the changes to be made in the zoning map <br />to reflect the zoning changes as provided in Ordinance No. 76-159. <br />SECTION 4: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety and welfare, and fnr the further reason that <br />it is immediately necessary to adopt this Ordinance prior to ninety <br />\;(90) days before the Primary Election so that it can be placed on <br />the June primary ballot, and further provided it receives the affirma- <br />tive vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its passage and approval <br />by the Mayor.
