SHARPE l AN ORDINANCE AUTHORIZING AND DIRECTING THE SUBMISSION OF A ZONING QUESTION TO THE CUYAHOGA COUNTY BOARD OF ELECTIONS FOR THE PURPOSE OF PLACING SAID QUESTION ON THE JUNE 6, 1978, PRIMARY BALLOT, WHICH QUESTION DEALS WITH THE REZONING OF CERTAIN LANDS FROM C SINGLE RESIDENCE DISTRICT TO MULTIPLE RESIDENCE DISTRICT, WHICH PROPOSAL IS MORE SPECIFICALLY DESCRIBED IN ORDINANCE N0. 76-159 ADOPTED BY THIS COUNCIL ON JANUARY 18, 19773, AND DECLARING AN EMERGENCY. WHEREAS, Council heretofore approved the rezoning of certain lands described in Ordinance 76-159, and WHEREAS, at the time said ordinance was introduced a Charter provision providing for the placing of rezoning of land to multi- family use had not yet been effective, and WHEREAS, it is the desire of this Council to have the question of rezoning, as specified in Ordinance 76-159 placed before the electors for their approval or rejection. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That this Council does hereby determine that the propose rezoning specified in Ordinance 1976-159, which is made a part hereof and incorporated by reference, would constitute additional multiple dwelling units in excess of twenty percent (20%) of all dwelling units in the City of North Olmsted so as to rec{uire said proposal to be referred to the electors of the City of North Olmsted in compliance with Article VIT, Section 2(e). SECTION 2: That this Council does hereby direct the Clerk of Council, upon the approval of this Ordinance, to submit this Ordinance to the Cuyahoga County Board of Elections for submission to the electors at a Primary Election to be held on June 6, 1978. SECTION 3: That the City Engineer is hereby directed, upon the approval o this Ordinance by the majority of the electors voting thereon, to cause the changes to be made in the zoning map to reflect the zoning changes as provided in Ordinance No. 76-159. SECTION 4: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and fnr the further reason that it is immediately necessary to adopt this Ordinance prior to ninety \;(90) days before the Primary Election so that it can be placed on the June primary ballot, and further provided it receives the affirma- tive vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
