<br />AN ORDINANCE AUTHORIZING THE BUILDTNG COMMISSIONER
<br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE
<br />BUILDING ON PERMANENT PARCEL NOS. 235-17-11 AND
<br />235-17-12 AT 5858 FITCH ROAD IN THE CITY OF NORTH
<br />OLMSTED.
<br />WHEREAS, pursuant to the provisions of Chapter No. 1331.01
<br />to 1331.99 of the Codified Ordinances of the City of North Olmsted,
<br />the Building Commissioner has determined that the abandoned dwell-
<br />ing known as Permanent Parcel Nos. 235-17-11 and 235-17-12 and
<br />located at 5858 Fitch Road, North Olmsted, Ohio, the record title
<br />holder, the State of Ohio, is unsafe, dangerous to human life and
<br />hazardous to the safety, health, and public welfare of the citizens
<br />of North Olmsted, and
<br />WHEREAS, notice to repair, remove, and demolish said building
<br />was served by registered letter on said record title holder on
<br />December 28, 1977, ordering said title holder to repair, remove,
<br />or demolish said building and to commence such repair, removal,
<br />or demolition within forty-eight (48) hours of receipt of said
<br />notice, and
<br />WHEREAS, said record title holder, the State of Ohio, failed
<br />to file an appeal within fifteen (15) days and has failed to camply
<br />with the order of the Building Commissioner.
<br />NOW, THEREFORE, BE IT ORDAZNED BY THE COUNCIL OF THE CITY
<br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHTO:
<br />SECTION 1: That Council deems it necessary to proceed with
<br />the demolition and removal of the dwelling at 5858 Fitch Road, North
<br />Olmsted, Ohio, also known as Permanent Parcel Nos. 235-17-11 and
<br />235-17-12, owned by the State of Ohio, whose mailing address is
<br />State Department of Highways, 10100 Broadway Avenue, Garfield Heights,
<br />Ohio-44125, by reason of the fact that said dwelling has been deter-
<br />mined to be dangerous to human life and a hazard to the public
<br />safety, health, and welfare of the citizens of the City of North
<br />Olmsted, and that the cost of said demolition and removal be paid
<br />from the General Fund of the City of North Olmsted, and charged to
<br />the owner as a special assessment or lien on said parcels of land,
<br />and assessed and collected in the manner of other assessments as
<br />provided by law.
<br />SECTION 2: That the Clerk of Council be, and she is, hereby
<br />directe to orward a copy of this ordinance to the State of Ohio,
<br />c/o Thomas Krall, Division of Deputy Directors, State Department
<br />of Highways, 10100 Broadway Avenue, Garfield Heights, Ohio 44125.
<br />SECTION 3: That this ordinance shall take effect and be in
<br />force from an a ter the earliest period allowed by law.
