CITY OF NORTH OLMSTED ORDINANCE N0. 78-,4j-, ? BY : AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF THE CITY OF NORTH OLMSTED, A CHARTER AMENDMENT AMENDING ARTICLE IV SECTION 5, DEALING WITH THE FILLING OF VACANCIES ON COUNCIL, AND DECLARING AN EMERGENCY. WHEREAS, the Charter Review Commission of the City of North Olmsted in 1975 recommended that the terms of Council be increased to four (4) years together with other administrative positions, and WHEREAS, provisions were made for in-term elections with respect to administrative positions and in such provisions rovisions were made with respect to Council positions, and WHEREAS, it is the desire of this Council to submit to the electors a proposal which would establish a uniform policy with respect to filling vacancies. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That this Council hereby authorizes and directs t e su mission to the electors of the City of North Olmsted at an election to be held at the usual places o_f_ voting in said City on Tuesday, June 6, 1978, the following proposal to amend the Charter of the City of North Olmsted: Section 5 of Article III of the Charter relating to the filling of vacancies with respect to the Office of Councilmen be amended to provide for special elections under certain cir- cumstances depending upon when a vacancy appears during the term, such amended Section 5 of Article IV to read as follows: ARTICLE IV SECTION 5: Vacancies In the event the Office of Councilman shall become vacant the vacancy shall be filled by appointment for the unexpired term by a majority vote of the remaining members of Council eligible to vote. Said appointed individual shall serve for the unexpired term or until the election of a successor for the unexpired term at the next regular Municipal election provided that, (a) such election shall occur more than two (2) years prior to the expira- tion of the unexpired term, and (b) the vacancy shall have occurred more;?than one hundred twenty (120) days prior to such election. Subject to the provisions of this Section, if Council does not fill said vacancy within thirty (30) days, the Mayor shall appoint a Councilman to fill said vacancy. SECTION 2: That the foregoing proposed amendment shall become a part o the Charter of the City of North Olmsted upon the approval by a majority of the electors voting thereon.
