CITY OF NORTH OLMSTED <br />ORDINANCE N0. 78-,4j-, <br />? <br />BY : <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION <br />TO THE ELECTORS OF THE CITY OF NORTH OLMSTED, <br />A CHARTER AMENDMENT AMENDING ARTICLE IV SECTION <br />5, DEALING WITH THE FILLING OF VACANCIES ON <br />COUNCIL, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Charter Review Commission of the City of North <br />Olmsted in 1975 recommended that the terms of Council be increased <br />to four (4) years together with other administrative positions, <br />and <br />WHEREAS, provisions were made for in-term elections with <br />respect to administrative positions and in such provisions <br />rovisions were made with respect to Council positions, and <br />WHEREAS, it is the desire of this Council to submit to <br />the electors a proposal which would establish a uniform policy <br />with respect to filling vacancies. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That this Council hereby authorizes and <br />directs t e su mission to the electors of the City of North <br />Olmsted at an election to be held at the usual places o_f_ voting <br />in said City on Tuesday, June 6, 1978, the following proposal <br />to amend the Charter of the City of North Olmsted: <br />Section 5 of Article III of the Charter relating to the <br />filling of vacancies with respect to the Office of Councilmen <br />be amended to provide for special elections under certain cir- <br />cumstances depending upon when a vacancy appears during the <br />term, such amended Section 5 of Article IV to read as follows: <br />ARTICLE IV <br />SECTION 5: Vacancies <br />In the event the Office of Councilman shall become vacant <br />the vacancy shall be filled by appointment for the unexpired term <br />by a majority vote of the remaining members of Council eligible <br />to vote. Said appointed individual shall serve for the unexpired <br />term or until the election of a successor for the unexpired term <br />at the next regular Municipal election provided that, (a) such <br />election shall occur more than two (2) years prior to the expira- <br />tion of the unexpired term, and (b) the vacancy shall have <br />occurred more;?than one hundred twenty (120) days prior to such <br />election. Subject to the provisions of this Section, if Council <br />does not fill said vacancy within thirty (30) days, the Mayor <br />shall appoint a Councilman to fill said vacancy. <br />SECTION 2: That the foregoing proposed amendment shall <br />become a part o the Charter of the City of North Olmsted upon <br />the approval by a majority of the electors voting thereon.
