RESOLUTION NO. 1$65 <br />BY: MR. SCHWENK RESOLUTION AUTHORIZING REFUND <br />OF MONEY ADVANCED FOR THE <br />IMPROVEMENT OF SOOT ROAD FOR <br />THE CONSTRUCTION OF A WATER <br />MAIN. <br />,~ <br />~~, Whereas, M. A. Cecil, R. M. Haviland and Charles Geib in the <br />year 1937 advanced to the municipality of North Olmsted funds for <br />the purpose of improving Root Road by the construction of a water <br />main therein, and <br />Whereas, assessments were levied on certain premises, the <br />`owners of which did not advance funds for such purpose, and <br />Whereas, there is now in the Sinking Fund of the City of <br />North Olmsted from the unused portion of the money so advanced by the <br />above mentioned persons the sum of X411.00 which belongs to said <br />persons or their heirs, administrators, executors or assigns, and <br />Whereas, the portion belonging to each of said persons amounts <br />to tk~e sum of X137.00. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, STATE OF OHIO, THAT: <br />The unused portion of the Root Road water improvement fund <br />now in the Sinking Fund of said City be refunded to ~. A. Cecil, <br />R, M. Haviland and F . vJ. Dorn, Executor of the estate of Charles <br />Geib, deceased, in equal amounts of X137.00. <br />The Auditor is hereby authorized and directed to issue a <br />check drawn on the Treasurer of the City to each of said parties for <br />said sum of X137.00, which refund to said parties represents the un- <br />used portion advanced by said parties as herein stated. <br />This is an emergency measure nec®ssary for the public health, <br />peace and safety and to immediately provide for the refunding of <br />monies in the Sinking Fund which belong to the parties herein mentioned. <br />PASSED: December 16, 1952 <br />ATTEST: <br />E.
