RESOLUTION N0.1762 BY: Mr. Hatton A BESOLt~TION DECLARING IT NECESSARY TO I~IFROVE DQVBR CENTER ROAD F&t THE Nt~TN L IN'E OF THE SUBURHAN LAAiD CORPORATION TO THE H4~tTH VILLAGE LINE B1t CE3~iSTRt~CTING THEREIN A ~ATF~ft A~AAIN . ~tHERBAS the owners of more than 60~ of the foot frontage of property on DDover Center road from the North line of the Suburban '~"~ Land Corporation to the North Pillage Line, have petitioned i8 writ- ing for the improvement of said street by constructing therein a water main; now, therefore, BE IT RESOLVED by the Council of the Village of ~torth Olmsted, Ohio: Section 1. That it is necessary to improve Dover Center Bead from the North line of the Suburban Land Corporation to the North Village line, by constructing therein a water main in accord- ance with the pleas and specifications prepared by the Pillage Engineer. Section 2. That the grade of said street shall be the grade shown on the plans and specifications for said improvement, which said grade and elevations are hereby confir~aed and established as the garade of said street. Section 3. That the plans, specifications, estimates and profiles of the proposed improvement heretofore pre red by the Village Engineer and now filed in the office of the Village Clerk be, anti the same are hereby approved. Section ~.. That the cost of said improveraant shall be assessed by the foot front upon the following described lots and lands, to-wit, a.ll lots and lands bounding and abnttisg upe~n the proposed improvement, which said lots and lands are hereby deter- mined to be specially benefited by said improvement; and the co st of said improvement shall include the expense of preliminary and other .surveys,. of printing and publishing the notices, resolutions and ordiaances required, the serving of said notices, the cost of construction, together with interest on notes or bonds issued in anticipation of the collection of deferred assessments and all other necessary expenditures. Section 5. That the assessments so to be levied shall be paid in ten annual installments, with interest not to exceed six per cent per annum on deferred payments, provided the owner of any property assessed .may, at his option, pay such assessment in cash within thirty days fry and after the passage of the assessing ordinance, in which case said assessment shall not include any it em of interest upon notes or bonds to be issued in anticipation of the collection of deferred installments of assessments. Section b. That notes or bonds of the Village of North Olmsted Shall be issued in anticipation of the collection of assess- ments by installments and in an amount equal thereto. ~` Section 7. That resolution shall take effect and be in '~ force froffi and after the earliest period allowed by law.
