Resolution No. ~~ g ~ ~ <br />By Mr . ~~h~~ <br /> <br />~- RESOI~UTTOIv <br />DECLARING IT NECESSARY TO IMPROVE WALTER ROAD, FROM MAPLE RIDGE <br />ROAD TO A POINT 806 FEET NORTH OF MAPLE RIDGE ROAD, BY CONSTRUCTING <br />TI3EREIN A WATER FAIN . <br />point 806 feet north of Maple Ridge Road, is located partly in <br />the Village of Westlake and partly in the Village of North Olmsted, <br />and <br />EREA~S the Villages of Yes Hake and North Olmsted <br />have entered into an agreement for the improvement of Walter <br />Road, from Maple Ridge Road to a point 806 feet north of Maple <br />Ridge Road, by constructing therein a water main; nog, therefore, <br />BE IT RESOLVED by the Council of the Village of <br />North Olmsted, Ohio: <br />WHEREAS the owners of 60~ or more of the foot <br />frontage of property on Walter Road, from Maple Ridge Road to a <br />point 806 feet north of Maple Ridge Road, in the Village of <br />North Olmsted, have petitioned in writing for the improvement <br />of said street, between said points, by constructing therein a <br />water main, and <br />WHERE ~talter Road, from Maple Ridge Road to a <br />Section 1. That it is necessary to improve Walter <br />Road, from maple Ridge Road to a point 806 feet north of Maple <br />Ridge Road, by constructing therein a water main in accordance <br />with the plans anal specifications prepared by the Village Engineer. <br />Section 2. That. the grade of said street shall be <br />the grade shown on the plans and specifications far said improve- <br />ment, v~a.ich said grade and elevations are hereby confirmed and <br />established as the grads of said street. <br />Section 3. That the plans, specifications, estimates <br />and profiles of the proposed improvement heretofore prepared by <br />the Village Engineer and now filed in the office of the Village <br />Clerk be, and the same are :hereby, approved. <br />Section 4. That the cost of said improvement sha11 <br />be assessed by the foot front upon the following described lots <br />and lands, to wit, all lots and lands bounding and abutting upon <br />the proposed improvement, wb.ich said lots and lands are hereby <br />determined to be speci~~I.ly benefited by said improvement; and <br />the cost of said improvement shall include the expense of pre- <br />liminary and other surveys, of printing and publish~,n.g the notices, <br />resolutions and ordinances required, the serving of said notices, <br />the cost of construction, together with interest on notes or bands <br />issued 3n anticipation of the collection of deferred assessments <br />and all other necessary expenditures. <br />Section 5, That the assessments so to be levied <br />aha11 be paid in ten annual installments, with interest not <br />to exceed six per cent per annum on deferred payments, provid~.d <br />that the owner of any property assessed may, at his option, peg <br />such assessment in cash within thirty days from and after the <br />passage of the assessing ordinance, ix1 which case said assessment <br />sha11 net include any item of interest upon notes or bands to <br />be issued in. anticipation of the collection of deferred. install- <br />ments of assessments. <br />Section 6. That notes or bonds of the Village of <br />North Olmsted shall be issued in anticipation of the collection <br />of assessments by installments and in an amount equal thereto. <br />Section 7.
