BE IT ORDAINED BY 'i:7E COUTV'CI~ OF THE CITY OF PdORTH O~ZSTED, STATE OF OHIO: Section 1. No person, firm or corcor~~tion shall mal=e any opening in any streets, boulevards, avenues or public places in the City of North Olmsted until such person, firm or corporation shall file with the T~ayor of the City a written or p tinted application setting forth and indicating thereon the location, kind and extent of the pavement desired to be taken up, the number, pur~:ose and size of openings or excavations which are de- sired or necessary. The applicant shall pay to the City of North Olmsted the sum of X3.00 for the General Fund before the permit. is issued and shall deposit with the City an additional amount sufficient to cover the cost of ~~ repairing and relaying the said pavement to be removed, together with the cost of any new material required, plus fifteen per cent (15DO} for the cost of inspection and general supervision, ~-~s the same shall be estimated by the T~ayo r. Section 2. Pap such permit shall be issued until (e~} the applicant shall have made the deposit referred to in Section 1. Said permit shall state the exact time when the opening or excavation is to be made, the probable length of time required for doing the work and the making of the repair, the character of the pavement, including its base, and the charac- ter of the work necessary for the satisfactory relaying of the pavement. It shall 'oe the duty of the City itself to relay the pavement, either temporarily or permanently, as may be determined by the P~Iayar~ and (b) A policy or policies of liability or indemnity insurance. issued by companies licensed to do busi mess in the State of Ohia, recog- nizing the City of North Olmsted as an insured, in a total amount of not less than X100,000/300000.00 for any personal injury and X50,000.00 for any property damage, caused as a result or consequence of the making or existence of such opening or excavation or the condition of the road, street, sidewalk, teee lawn or other public property in which the same is or has been made. Section 3. u~lhen such work is completed and -the pavement relaid, the T~ayor will deterrline the cost of the work of relaying the pavement, to- gether with the cost of new materials required and the cost of inspection and supervision, as the case may be, which amount shall be deducated from the deposit made by the applicant and the Auditor shall issue a check to the applicant for the return of the excess over and above the amount nec- essary to reimburse the City for the expense of relaying the pavement, together Uyrith the cost of new material and supervision. Section. If the deposit be insufficient to reimburse the City, the Mayor s 11 collect from the applicant a sufficient amount to reimburse the City for the expense incurred. Section 5. Section 6.
