This shall be done only after reference to <br />and report by the City Planning Commission; and after public hearing, <br />notice of which shall be given in a newspaper of general circulation in <br />the City not less than thirty (30) days prior to such hearing, as provided <br />by law. Ptotice shall also be given to property owners within a radius of <br />300 feet, residing in Cuyahoga County and whose place of residence can b8 <br />readily ascertained. <br />(b) In case of proposed amendment, supplement or change <br />be disapproved by the Planning Corarnission, such amendment, supplement or <br />change shall not be passed except by an affirmative vote of not less than <br />two-thirds of the full membership of Council. In considering such pro- <br />posed amendments supplement or changes the Planning CorrBnission shall give <br />weight to arxy protest presented, duly signed by the owners of twenty (20) <br />percent or more either of the area of the lots included in such proposed <br />change or of those owners of property within a radius of 500 feet of the <br />property in question;, <br />(c) Council shall take final action upon such proposed <br />amendment, supplement or change within forty-five {lt5) days after the filing <br />of petition for same with the Clerk of Council, and if Council shall fail to <br />take action upon such petition within said time the petition shall be <br />deemed to have been re~ecteda <br />ARTICLE XVIII <br />VALE <br />Section 1. 9ALIDITY. <br />If at~Qt sections clause, provision or portion of this <br />ordinance shall be held to be invalid or unconstitutional by at~y court <br />of competent 3urisdiction, such holding shall not affect or impair any <br />other section, clause, provision or portion of the ordinance. <br />ARTICLE IXX <br />C013FI,ICT <br />Section 1. CONFLICT. <br />Ordinances #62, Section 125, 130, 135, 1tt0, 1~.5, 150, <br />155, 160, 165, 170, 175 or Ordinance #122, Ordinance #x`329, #3~t0, #529, <br />rt533, #x`539, #510, ir561-, #572, #5Tlt, #592, #62b, #663, #751, x'761, #789, <br />#825, #829, #86l~, #1011 and all other Ordinances or parts of Ordinances <br />in conflict herewith or contrary hereto, be and the same are hereby <br />repealed. <br />
