ORDINANCE N0. ~'~~3 <br />BY~ Mn'. AN ORDINANCE TO LEVY SPECIAL ASSESS- <br />MENTS -FOR THE Il~fPROVE~~NT OF P~~ARTIN DRIVE. <br />FROM PORTER ROAD TO ITS SOUTHERLY END, BY <br />CONSTRUCTING THEREIN A WATER 14~iIN. <br />BE IT ORDAINED BY `S'HE COUNCIL OF THE CITY OF I`JOtZTH OLMSTED, <br />STATE OF OHIO:, <br />Section 1. That the assessment of the cost and expense of <br />' improving Martin Drive from Porter Road to its southerly end by con- <br />structing therein-a water main, amounts in the aggregate to 33,000.40, <br />as reported to this Council by the City Engineer, notice of the filing <br />of which assessment has been given, as required by law, be and the same <br />is hereby adopted and confirmed and that there be and is hereby levied <br />upon all the lots and land bounding and abutting upon Martin Drive from <br />Porter Road to its southerly end, by constructing therein a water main, <br />the several mounts reported as aforesaid, which assessments, together <br />with the descriptions of said lots a rri la rids, are now on file in the <br />office of the Clerk of this Council, and which assessments are at the <br />rate of 5.2213 per front foot and are not in excess of the special <br />benefits. to said property. <br />Section 2. That the total assessments against each lot or <br />parcel of land s~.l be payable in cash within thirty days from and <br />after the passage of this ordinance , or at the option of the owners, <br />in ten annual installments with interest at the same rate as shall be <br />borne by the bonds to be issued in anticipation of the collection of <br />the same. All cash payments shall be made to the Treasurer of said <br />City. All assessments and installments thereof remaining unpaid at <br />the expiration of said thirty days shall be certified by the Clerk of <br />this Council to the County Auditor, as provided by law, to be by him <br />placed on the tax duplicate and collected as other taxes are collected. <br />Sectio~n,~. This ordinance is an emergency measure necessary <br />for the public health, peace, welfare and safety and to provide for the <br />immediate levying of special assessments to raise funds for a necessary <br />City street improvement and shall take effect and be in force from and <br />after the earliest period allowed by law. <br />PASSED: February v;~ , 1957• <br />ATTEST:. <br />~;~~~ --~ <br />E; Christman, Clerk of Council E.
