ORDINANCE N0. ~ ~ ~ / <br />BY: Mr. AN ORDINANCE TO LEVY SPECIAL ASSESSMENTS. <br />FOR THE IMPROVEMENT OF DECKER ROAD FROM <br />LORAIN ROAD TO MIDVALE AVENUE, BY CON- <br />STRUCTING THEREIN A STORM SEWER. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />STATE GF OHIO; <br />Section 1. That the assessment of the cost and expense <br />of improving Decker Road from Lorain Road to Midvale Avenue, by con- <br />structing therein a storm sewer, amounts in the aggregate to 23,$00.00, <br />as reported to this Council by the City Engineer, notice of the filing <br />of which assessment has been given, as required by law, be and the same <br />is hereby adopted and confirmed and that there be and is hereby levied <br />upon all the lots and land bounding and abutting upon .Decker Road from <br />Lorain Road to Midvale Avenue, by constructing therein a storm sewer, <br />the several amounts reported as aforesaid, which assessments, together <br />with the descriptions of this Council, aril which assessments are at the <br />rate of 6.1979 per front foot and are not in excess of the special <br />benefits to said property. <br />Section 2. That the total assessments against each lot or <br />parcel of land shad be payable in cash within thirty days from and <br />after the passage of this ordinance, or at the option of the owners, <br />in ten annual installments with interest at the same rate as shall be <br />borne by the bonds to be issued in anticipation of the collection of <br />the same. All cash payments shall be made to the Treasurer of said <br />City. All assessments and installments thereof remaining unpaid at <br />the expiration of said thirty days shall be certified by the Clerk of <br />this Council to the County Auditor, as provided by law, to be by him <br />placed on the tax duplicate and collected as other taxes are collected. <br />Section 3. This ordinance is an emergency measure necessary <br />for the public health, peace, welfare and safety and to provide for the <br />immediate levying of special assessments to raise funds for a necessary <br />City street improvement and shall take effect and be in force from and <br />after the earliest period allowed by law. <br />PASSED; February ~ ~, 195'7 • <br />ATTEST: <br />E M. .,hristman, C er ci <br />APP~.OVED <br />~~~1, <br />harles B.
