OftDINAN CE N0. ,? ~,/ ~ o <br />BY: NIr. ~°/Lt,dtit~ AN OftT?INANCE TO ZEEVY SPECIAIa ASSESSTkTENTS <br />FaR THE TMPROVEMETdT OF DECKER ROAD FROM <br />I~TIDVALE AVENUE TO SOUTHERN AVENUE, BY <br />CONSTRUCTING THEREIN A WATER MAIN. <br />BE IT ORDAINED BY rl'HE COUNCIL OF T H~ CITY OF NORTH OLI~ISTED, <br />STATE OF OHIO: <br />Section 1. That the assessment of the cost and expense of <br />improving Decker Road from Midvale Avenue to Sauthern Avenue by con- <br />structing therein a water main, amounts in the aggregate to 15,200.00, <br />as reported to this Council by the City Engineer, notice of the filing <br />of which assessment has been given, as regv_ired by law, be and the same <br />is hereby adopted and confirmed and that there be and is hereby levied <br />upon all. the lots a ~i. land bounding and abutting upon Decker ftaad from <br />Midvale Avenue to Southern Avenue, by constructing therein a water main, <br />the several amounts reported as aforesaid, which assessments, together <br />with the descriptions of said lots and lands, are now o n file in the <br />office of the Clerk of this Council, and which assessments are at the <br />rate of ~1~.06$2 per front foot and are not in excess of the special <br />benefits to said property. <br />Section 2. That the total assessments against each lot or <br />parcel of land shall be payable in cash within thirty days from and <br />after the passage of this ordinance, or at the option of the owners., <br />in ten annual installments with interest at the same rate as shall <br />be borne by the bonds to be issued in anticipation of the collection <br />of the same. All cash payments shall be made to the Treasurer of said <br />City. X1.1 assessments and installments thereof remaining unpaid at the <br />expiration of said thirty days shall be certified by the Clerk of this <br />Council to the County Auditor, as provided by law, to be by him placed <br />on the tax duplicate and collected as other taxes are collected. <br />Section 3. This ordinance is an emergency measure necessary <br />for the public health, peace, welfare and safety and to provide for <br />the immediate levying of special assessments to raise funds for a <br />necessary City street improvement and shall take effect and be in force <br />from and after the earliest period allowed by law. <br />PASSED: February !/ , 1957• <br />ATTEST:. <br />~.. kris an, er of Council <br />E.
