FF~OM <br />BARYON ROAD NORTHERLY 976 FEET, BY <br />CONSTRUCTING THEREIN A WATER PAIN,. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLT~I,STED, <br />STATE OF OHIO:: <br />Section 1. That it is hereby determined to proceed with the <br />improvement of -Bradley Road from Barton Road northerly 976 feet, by con- <br />structing therein a water main, in accordance ~,rith Resolution No, 239$, <br />passed November 26, 1956, and the petition of property owners described <br />in said Resolution and in accordance with the plans, specifications, <br />estimates and profiles heretofore approved and now on file in the office <br />of the Director of Public Service. <br />Section 2, That all claims for damages resulting therefrom <br />shall be judiciary-inquired into after the completion of the proposed <br />improvement, and the solicitor be, and he is hereby authorized and <br />directed to institute proceedin,os in a court of competent jurisdiction <br />to ineuire into such claims. <br />Section 3. That the cost of said improvement shall be <br />assessed by the foot front upon the following described lots and <br />lands, to-wit, all lots and lands bounding and abutting upon the <br />proposed improvement, which said lots and lands are hereby determined <br />to be specially benefited by said improvement; and the cost of said <br />improvement shall include the expense of preliminary and other sur- <br />veys, of printing and publishing the notices, resolutions and ordinances <br />required, the service of said notices, the cost of construction' to- <br />gether with interest on notes or bonds issued in anticipation of col - <br />lection of deferred assessments and all other necessary expenditures. <br />Section 4. That the assessments so to be levied shall be <br />paid in ten annual installments, with interest not to exceed six per <br />cent per annum on deferred payments, provided that the owner of any <br />property assessed may, at his option, pay such assessment in cash <br />within. thirty days from and after the passage of the assessing ord- <br />inance, in which case said assessment shall not include any item of <br />interest upon notes or bonds to be issued in anticipation of the col- <br />lection of deferred installments of assessments. <br />Section 5. That notes or bonds of the City of North Olmsted <br />shall be issued in anticipation of the collection of assessments by <br />installments and in an amount equal thereto, <br />Section 6. That the City Engineer be and he is hereby <br />directed to prepare and file with this Council a tentative assessment <br />showing the amount to be assessed on each lot or parcel of land to be <br />assessed. <br />Section 7. That the Director of Public Service be, and he <br />is hereby authorized and directed to advertise for bids for the con- <br />struction of said improvement according to law. <br />~, Section $.
