<br />THE IMPROVEMIENT OF KENNEDY RIDGE R©AD
<br />FROM COLUMBIA ROAD TO BUTTERD'tTT RIDGE:
<br />ROAD, BY CONSTRUCTING THEREIN A WATER
<br />rvTAIN.
<br />BE IT t3RDA:LNED BY THE COUNCIL'' OF THE CITY OF NORTH 07~lSTED,
<br />STATE OF OHIO:
<br />S,~ection 1. That it is hereby determined to proceed with the
<br />improvement o.~en~edy Ridge Road from Columbia Road to Butternut Ridge,
<br />by constructing-therein a water main, in accordance with 8.esolution
<br />No, 2399, passed November 26, 1956, and in accordance with the p~.ans,
<br />specifications, estimates and profiles heretofore approved and now on
<br />file in the office of the Director of Public Service.
<br />Section That all claims for damages resulting therefrom shall
<br />be judicia~,y inquired into after the completion of the proposed improve-
<br />ment, and the solicitor be, and he is hereby authorized and directed to
<br />institute proceedings in a court of competent jurisdiction to inquire into
<br />such claims.
<br />Section,. The whole cast of said improvement, less 1/50th
<br />thereof and the cost of intersections, if any, shall be assessed by the
<br />foot front upon the following described lots and lands, to-wit:: all lots
<br />and lands bounding and abutting upon both sides ofKennedy Ridge &vad from
<br />Columbia Road to Butternut Ridge Road, in the City of North Olmsted, which
<br />said lots and lauds are hereby determined to be specially benefited by said
<br />improvement; and the cost of said improvement shall include the expense of
<br />preliminary and other surveys, of printing and publishing the notices,
<br />resolutions and ordinances required, the service of said notices, the cost
<br />of construction, together with interest on notes or bonds issued in anticipa-
<br />tion of collection of deferred assessments and all other necessary expend-
<br />itures.
<br />Section 1~_ That the assessments so to be levied shall be paid
<br />in ten annua insta lments, ~ri.th interest not to exceed six per cent per
<br />annum on deferred payments, provided that the owner of any property assessed
<br />may, at his option, pay such assessment in cash within thirty days from and
<br />after the passage of the assessing ordinance, in which case said assessment
<br />shall not include any item of interest upon notes or bonds to be issued in
<br />anticipation of the collection of deferred installments of assessments.
<br />Section 5. That notes or bonds of the City of North Olmsted
<br />shall be issued in anticipation of the collection of assessments by install-
<br />ments and in an amount equal thereto.
<br />Section 6. That the City Engineer be and he is hereby directed
<br />to prepare and ~~-with this Council a tentative assessment shaving the
<br />sount to be a ssessed on each lot or parcel of land to be assessed.
<br />Se,~ etio~t .. That to pay the remainder of the cost of said improve-
<br />ment there be an zs hereby appropriated from the General Fund the sum of
<br />X1,244.90.
<br />Section~$. That the Director of Public Service be, and he is
<br />"~° hereby authorize and directed to advertise. for bids for the construction
<br />'~" of said improvement according to law..
<br />Section 9. This ordinance is hereby declared to be an emergency
<br />measure, the mergency being that it is necessary for the immediate preserves-
<br />tion of public health, peace, safety and welfare that this ordinance be
<br />passed at once and shall take effect and be in force from and after its
<br />passage;
