~„ RESOLUTION N0. ,~ 3„~_ BY_:: Mr. RESOLUTION DECLARING ZT NECESSARY TO IMPROVE KENNEDY RIDGE ROAD FROM COLUMBIA ROAD TO BUTTERNUT RIDGE ROAD:, BY CON- STRUCTING THEREIN A WATER MAIP~.. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORTH OINlSTED, STATE OF OHIO, THREE-FOURTHS OF ALL MEMBERS ELECTED THERETO CONCURRING:: Section 1. That it is deemed necessary and conducive to the public health, convenience, welfare and safety, by reason of the present necessity of providing proper and adequate water facilities and fire pro- tection for homes, to improve Kennedy Ridge Road from Columbia Road to Butternut Ridge Road, by constructing therein a water main. Section 2 That the grade of said street shall be the grade shown on t e plans-and specifications for said improvement, which said grade and elevations are hereby confirmed and established as the grade of said street. Section 3. That the plans, specifications, estimates and profiles of the proposed improvement heretofore prepared by the City Engineer and now filed in the office of the Director of Public Service- be and the same are hereby approved. Section l+. The whole cost of said improvement, less 1/~Oth thereof and the cost of intersections, if any, shall be assessed accord- ing to the foot front upon the following described lots and lands, to-wit: all lots and lands bounding and abutting up8n both sides of Kennedy Ridge Road, from Columbia Road to Butternut Ridge Road, in the City o_f North Olmsted, which said lots and lands are hereby determined to be specially benefited by said improvement; and the cost of said improvement shall include the expense of prelim3.gary and other surveys, of printing and publishing the notices, resolutions and ordinances requirp~d., the serving of said notices, the cost of construction, together with interest on notes or bonds issued in anticipation of collection of deferred assess- ments and all other necessary expenditures. Section That the assessments so to be levied shall be paid in ten annua~i-nstallments, with interest not to exceed six per cent per annum on deferred payments, provided that the owner of any property as- sessed may, at his option, pay such assessment in cash within thirty days from and after the passage of the assessing ordinances, in which case said assessment shall not include any item of interest upon notes or bonds to be issued in anticipation of the collection of deferred installments of assessments. Section 6. That notes or bonds of the City of North Olmsted shall be issued ire anticipation of the collection of assessments by installments and in an amount equal thereto. The remainder of the entire cost of said improvement not specially assessed shall be paid out of the General Fund, or by the issuance of bonds of the City of North Olmsted::.' for that purpose, in the manner provided by law.
