~„ <br />RESOLUTION N0. ,~ 3„~_ <br />BY_:: Mr. RESOLUTION DECLARING ZT NECESSARY TO <br />IMPROVE KENNEDY RIDGE ROAD FROM COLUMBIA <br />ROAD TO BUTTERNUT RIDGE ROAD:, BY CON- <br />STRUCTING THEREIN A WATER MAIP~.. <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORTH OINlSTED, <br />STATE OF OHIO, THREE-FOURTHS OF ALL MEMBERS ELECTED THERETO CONCURRING:: <br />Section 1. That it is deemed necessary and conducive to the <br />public health, convenience, welfare and safety, by reason of the present <br />necessity of providing proper and adequate water facilities and fire pro- <br />tection for homes, to improve Kennedy Ridge Road from Columbia Road to <br />Butternut Ridge Road, by constructing therein a water main. <br />Section 2 That the grade of said street shall be the grade <br />shown on t e plans-and specifications for said improvement, which said <br />grade and elevations are hereby confirmed and established as the grade <br />of said street. <br />Section 3. That the plans, specifications, estimates and <br />profiles of the proposed improvement heretofore prepared by the City <br />Engineer and now filed in the office of the Director of Public Service- <br />be and the same are hereby approved. <br />Section l+. The whole cost of said improvement, less 1/~Oth <br />thereof and the cost of intersections, if any, shall be assessed accord- <br />ing to the foot front upon the following described lots and lands, to-wit: <br />all lots and lands bounding and abutting up8n both sides of Kennedy Ridge <br />Road, from Columbia Road to Butternut Ridge Road, in the City o_f North <br />Olmsted, which said lots and lands are hereby determined to be specially <br />benefited by said improvement; and the cost of said improvement shall <br />include the expense of prelim3.gary and other surveys, of printing and <br />publishing the notices, resolutions and ordinances requirp~d., the serving <br />of said notices, the cost of construction, together with interest on <br />notes or bonds issued in anticipation of collection of deferred assess- <br />ments and all other necessary expenditures. <br />Section That the assessments so to be levied shall be paid <br />in ten annua~i-nstallments, with interest not to exceed six per cent per <br />annum on deferred payments, provided that the owner of any property as- <br />sessed may, at his option, pay such assessment in cash within thirty <br />days from and after the passage of the assessing ordinances, in which <br />case said assessment shall not include any item of interest upon notes <br />or bonds to be issued in anticipation of the collection of deferred <br />installments of assessments. <br />Section 6. That notes or bonds of the City of North Olmsted <br />shall be issued ire anticipation of the collection of assessments by <br />installments and in an amount equal thereto. The remainder of the <br />entire cost of said improvement not specially assessed shall be paid <br />out of the General Fund, or by the issuance of bonds of the City of <br />North Olmsted::.' for that purpose, in the manner provided by law. <br />Secti®s.~~ This resolution shall <br />from and a ter the earliest period allowed by <br />PASSED: ~~~ ~''~ ~ <br />ATTEST: <br />E.
