FROM <br />MARTIN DRIVE EASTERLY 1322.t~6 FEET, BY <br />CONSTRUCTING THEREIN A t+TATE~~ MAIN. <br />BE IT ORDAlN~,D ;~3Sr ~~'H C~~UNCIL OF THE CxT~Y OF NORTH Oi,MSTED, <br />STATE OF OHIO: <br />Section 1. That it is hereby determined to proceed with the <br />improvement~o~`~roo park Road from Martin Drive easterly 1322.J~6 feet, <br />within the City of North Olmsted, by constructing therein a water main, <br />in accordance with Resolution No. 23$1, passed October 23, 1956, and the <br />petitio~j of property owners described in said Resolution and in accord- <br />ance with the plans, specifications, estimates and profiles heretofore <br />approved and now on file in the office of the Director of Public Service. <br />Section 2. That all claims for damages resulting therefrom <br />shall be judicially inquired into after the completion of the proposed <br />improvement, and the solicitor be, and he is hereby authorized and <br />directed to institute proceedings in a court of competent jurisdiction <br />to inquire into such claims. <br />Section That the cost of said improvement shall be <br />:assessed bye oot front upon the following described lots and <br />lands, to-wit, all lots ar~d lands bounding and abutting upon the <br />proposed improvement, which said lots and lands are hereby determined <br />to be specially benefitl~d by said improvement; and the cost of said <br />improvement shall include the expense of preliminary and other sur- <br />veys, of printing and publishing ithe notices, resolutions and ordinances <br />required, the service of said notices, the cost of construction, to- <br />get~~r with interest on notes or bonds issued in anticipation of col- <br />lection of deferred assessments ar~d all other necessary expenditures. <br />Section 4. That the assessments so to be levied shall be <br />paid in ten annual installments, with interest not to exceed six per <br />cent per annum on deferred payments, provided that the owner of any <br />property assessed may, at his option, pay such assessment in cash <br />within thirty days from and after the passage of the assessing ord- <br />inance, in which case said assessment shall not include any item of <br />interest upon notes or bonds to be issued in anticipation of the cols <br />lection of deferred installments of assessments. <br />Section 5. That notes or bonds of the City of North Olmsted <br />shall be issued in anticipation of the collection of assessments by <br />installments and in an amount equal thereto. <br />Section 6. That the City Engineer be and he is hereby <br />directed to .prepare-and file with this Council a tentative assessment <br />showing the amount to be assessed on each lot or parcel of land to be <br />assessed. <br />Section ?. That the Director of Public Service be, and he <br />is hereby authorized and directed to advertise for bids for the con- <br />struction of said improvement according to law. <br />Section $.
