<br />ROAD.
<br />BE IT ORDAII~IED BY THE COUNCIL, OF THE CITY OF NORTH O~NlSTED,
<br />STATE OF OHIO::
<br />Section 1 That it is hereby determined to proceed with
<br />the improveme~~ague Boad Road from 3~orain Road to I~a,stick Load, by
<br />constructing and installing a five foot concrete .public sidewalk on both
<br />sides of said Clague ftflad, ~,n accordance with resolution No 231.1,., passed.
<br />~,,, June 19, 1956, and the petition of property owners described in said
<br />resolution and in accordance with the plans, specifications, estimates
<br />and profiles heretofore approved and now on file in the office of the
<br />Director of Public Service.
<br />Section 2,= That all claims for damages resulting therefrom
<br />shall be ju~r i-c .a..y -inquired into after the completion of the proposed
<br />improvement, and the solicitor be, and he is hereby authorized and
<br />directed to institute proceedings in a court of competent jurisdiction
<br />to inquire into such claims..
<br />:~ection„~,s, That the cost of said improvement shall be
<br />assessed bp~e~oot fpont upon the following described lots and.
<br />lands, to-wit, all lots and lands bounding and abuttsag upon the
<br />proposed improvement which said lots and lands. are hereby determined;.
<br />to be specallg bene~ited by said improvement; and the cost of said
<br />improvement shall include the expense of preliminary and other sur-
<br />veys, of printing and publishing the notices, resolutions and ordinances
<br />required, the service of said notices, the cost of construction, to-
<br />gether with interest on notes or bonds issued in anticipation of col-
<br />lection of deferred assessments and all other necessary expenditures.
<br />5,~ coon That the assessments so to be levied shall be
<br />paid in tern-annua,~-installments, with interest not to exceed six per
<br />cent per annum on deferred payments, provided that the owner of any
<br />property assessed may, at his option, pay such assessment in cash
<br />within thirty days froffi and after the passage of the assessing ord-
<br />inance, in which case said assessment shall not include any item of
<br />interest upon notes or bonds to be issued in anticipation of the col-
<br />lection o fdeferred installments of assessments.
<br />3ecton„~ That notes or bonds of the City of North Olmsted
<br />shall be issues in anticipation of the collection of assessments by
<br />installments and in an amount equal thereto.
<br />Sec~io,~n 6 That the City Engineer be and he is hereby
<br />directed t© prepare and file with this Council a tentative assessment
<br />showing the amount to be assessed on each lot or parcel of land to be
<br />assessed.
<br />Section ~ That the Director of Public Service be, and he
<br />is hereby aut"Ta ae and directed to advert~.se for bids for the con-
<br />struction of said improvement according to law.
<br />Section $ This ordinance is hereby declared to be an emer-
<br />gency measure, t e emergency being that it is necessary for the immed-
<br />iate preservation of public health, peace, safety and welfare that this
<br />ordinance be passed at once and shall take effect and be in force from
<br />and after its passage.
