CONSTRUCTING <br />THEREIN A WATER A+IAI~. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLNISTED, <br />STATE OF OHIO: <br />Sec ion_],a That it is hereby deterffiined to proceed with the <br />improvement-o.-~ eck®r Road from Midvale Avenue to Southern Avenue, by <br />co~tructing therein a water ma.i.n, in accordance w~i.th Resolution No. 2226, <br />passed Novaeorber 1, 1955, and the petition of property owners described in <br />said Resolution and in accordance with the pleas, specifications, estimates <br />aad profiles heretofore approved aad now on file in the office of the <br />Director of Public Service. <br />3_ec ion 2. That all clams for damages resulting therefromm <br />shall be ~udic~-inquired into after the commpletion of the proposed <br />iapraveffient, and the solicitor be, and he is hereby authorised and <br />directed to institute proceedings, in a court of coapeteat jurisdiction <br />to inquire into Bauch claims. <br />'oa That the cost of said improvement shall be <br />assessed by the .-o©t front upon the follo~ring described lots and <br />lands, to-trit, all lots aad lands bounding and abutting upon the <br />proposed improvement which said lots and lands are h®reby determined <br />to be specially beae~ited by said improvement; aad the cost of said <br />improvement shall include the ejcpease of preliminary sad ether sur-~ <br />vet's, of printing and publishing the notices, resolutions and ordinances <br />required, the service of said notices, the cost of coa~struction to- <br />gether with interest on notes or boucle issued in anticipation o~ col- <br />lection of deferred assessments and all oth®r necessary expenditures. <br />S~Qa That the assessments so to be levied shall be <br />paid is ten-affinu ~nstallmeats, with interest not to exceed six per <br />cent per aaa~ on deferred payments, privided that the owner of any <br />property assessed may, at his option, pay such assessment in cash <br />within thirty days from aad after the passage of the assessing ord- <br />inance, in which case said assesammemt shall not include any itean of <br />interest upon notes or bonds to be issued is anticipation of the col- <br />lection of d®ferred installments of assessments.° <br />ctio ,~ That notes or bonds of the City of North Oltested <br />shall be is~ui~ ;ant3.cipatioa of the collection _ of assessments by <br />install.reents and in an amount equal thereto.- <br />3ectio That the City 8ngiaeer be and he is hereby <br />directed tQ • pree -and file with this Council a tentative assessorent <br />showing the amount to be assessed on each lot or parcel of land to be: <br />assessed. <br />ct o, That the Director of Public Service be ,and he <br />is hereby au ~ o~ a and directed to advert~.se for ,bids for the coa- <br />structioa of said improvement according to law= <br />cti ~ This ®rdiaance is hereby declared to be as emer- <br />gency oreastAx~e, t e -®mergency being that it is necessary for the i ai- <br />iate preservation of public health, peace, safety aad welfare that this <br />ordinance be passed at pace and shall take effect aad be in force from <br />and after its passag®. ___~ <br />PASSED: <br />ATTEST <br />APPROVED:: <br />~I'63514~9 <br />~-a- - r-.~- of Council.' <br />~,,.. <br />~~~; 3~~~ <br />34 <br />
