ORDINANCE NO. 2160. <br />BY: Mr. Schwenk. AN ORDINANCE TO LEVY SPECIAL ASSESS~~IENTS <br />FOR THE IMPROVEMENT OF CANTERBURY ROAD <br />FROM Lt~iAIN ROAD TO A DRAINAGE DITCH <br />3000 FEET NORTHERLY THEREFR(~, BY CON- <br />STRUCTING THEREIN A STORM SEWER. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, STATE OF OHIO: <br />Section. 1. That the assessment of the cost and expense <br />of improvi.xtg~ nterbury Road from Lorain Road to a drainage ditch <br />3000 feet northerly therefrom, by constructing therein a storm <br />sewer, amounts in the aggregate to 35,900.00, as reported to <br />this Council by the City Engineer, notice of the filing of which <br />assessment has been given, as required by law, be and the same is <br />hereby adopted and confirmed and that there be and is hereby levied <br />upon all the lots and land bounding and abutting upon Canterbury <br />Road from Lorain Road to a drainage ditch 3040 feet northerly <br />therefrom, by constructing therein a storm sewer, the seQeral amounts <br />reported as aforesaid, which assessments, together with the d®scrip- <br />tions of said lots and lands, are now on file in the office of the <br />Clerk of this Council, and which assessments are at the rate of <br />6.3466 per front foot and are not in excess of the special benefits <br />to said property. <br />Section 2. That the total assessments against each lot <br />or parcel o, -and shall be payable in cash within thirty days from <br />and after the passage of this ordinance, or at the option of the <br />owners, in ten annual installments with interest at the same rate <br />as shall be borne by the bonds to be issued in anticipatiaa of the <br />collection of the same. All cash payments shall be made to the <br />Treasurer of said City. All assessments and installments thereof <br />remaining unpaid at the expiration of said thirty days shall be <br />certified by the Clerk of this Council to the County Auditor, as <br />provided by law, to be by him placed on the tax duplicate and <br />collected as other taxes are collected. <br />Se~cti_Qn 3, This ordinance is an emergency measure <br />necessary for the public health, peace, welfare and safety and to <br />provide for the immediate levying of special assessments to raise <br />funds for a necessary City street improvement and shall take effect: <br />and be in force from and after the earliest period allowed by law. <br />PASSED: June 21, 1955. <br />ATTEST: <br />r <br />~. <br />.
