ORDINANCE NO. 2.1.37. <br />By; Mr. Decker. AN: ORDINANCE TO LEVY SPECIAL ASSESSMENTS <br />FOR THE IMPROV ~' T OF ROOT ROAD FROM END <br />OF EXISTING MAIN NORTHERLY 1203 FEET, BY <br />CONSTRUCTING. THEREIN A WATER MAIN. <br />BE IT ORDAINED BY THE. COUNCIL. OF THE CITY OF NORTH <br />OLMSTED, STATE OF OHIO; <br />Section 1. That the assessment of the cost and expense <br />of improving Root Road from the end of the existing main northerly <br />1203 feet, by construct~.ng therein a water main, amounts in the <br />aggregate to X9,300.00, as reported to this Council by the City <br />Engineer, notice of the filing of which assessment has been given, <br />as required by law, be and the same is hereby adopted and confirmed <br />and that there be and is hereby levied upon all the lots and land <br />bounding and abutting upon Root Road from the end of the existing <br />main northerly 1203 feet, by constructing therein a water main, the <br />several amounts reported as aforesaid, which assessments, together <br />with the descriptions of said lots and lands, are now on file in the <br />office of the Clerk of this Council, and which assessments are at <br />the rate of X3.$615 per front foot and are not in excess of the <br />special benefits to said property. <br />Section 2. That the total assessments against each lot <br />or parcel of land shall be payable in cash within thirty days from <br />and after the passage of this ordinance, or at the option of the <br />owners, in ten annual installments with interest at the same rate <br />as shall be borne by the bonds to be issued in anticipation of the <br />collection of the same. All cash payments shall be made to the <br />Treasurer of said City, All assessments and installments thereof <br />remaining unpaid at the expiration of said thirty days shall be <br />certified by the Clerk of this Council to the County Auditor, as <br />provided by law, to be by him placed on the tax duplicate and <br />collected as other ta;:es are collected. <br />Section 3. This ordinance is an Pmergency measure <br />necessary for the public health, peace, welfare and safety and to <br />provide for the immediate levying of special assessments to raise <br />funds for a necessary City street improvement and shall take effect <br />and be in force from and. after the e~~rliest period a11ov,*ed by law. <br />PASSED: May 1~, x_955. <br />ATTEST: <br />E.
