EDiD: <br />QF EgISTING MAIM NORTHERLY TG NfH CITI <br />LIA1E s B'Y CONSTRUCTING THEREIN A WATER MAIN.:. <br />BE IT aRDAINED BY THE COUNCIL 4F THE CITY OF NORTH OLMSTEII, <br />STATE OF OHIO: <br />Section 1 That it is hereby determixed to proceed with <br />the iaprav~ent rter Road from the end of the existing main to thee. <br />north city line, by constructing therein a water main is accordance <br />with Resolution No, 2099, passed March 1, 1955, and tie petition of <br />property owners described in said Resolution and in accordance with <br />the plans, specifications, estimates and profiles heretofore approved <br />and now on file in the office of the Director of Public Service, <br />3„ction 2,= That all claims for damages resulting therefrom <br />shall be jud~iei-may inquired into after the completion of the proposed. <br />improvement, and the solicitor b®, and he is hereby authorised and <br />directed to institute proceedings in a court of competent jurisdiction <br />to inquire into such claims. <br />Section That the cost of said improvement shall be <br />assessed by tie .oot front upon the following described lots and <br />lands, to-merit, all lots and lands bounding and abutting upon the <br />prop®sed i.mprovement~ which said l®ts and lands are hereby determined- <br />to be specially benefited by said improvement; and the cost of said <br />improvement shall include the expense of preliminary and other sur- <br />veys, of printing and publishing the notices, resolutions and ordinances <br />required the service of said notices, the cost of construction, to- <br />gether w~th interest on Hates or bonds issued in anticipation of col- <br />lection of deferred assessments and all other necessary expenditures. <br />Section That the assessments so to be levied shall be: <br />paid in ten annua installments, with interest not to exceed six per <br />cent per annum on d®ferred payments, provid®d that the owner of any <br />property asss~se~t may, at his option, pay such assessment in cash <br />within thirty daps from and after the passage of the assessing; ord- <br />inance, in which case said assessment shall not include any item of <br />interest upon notes or bonds to be issued in anticipation of the col- <br />lection of deferred installments of assessments. <br />3.®ctiaa 5. That notes or bonds of the City of North Olmsted <br />shall be issued in anticipation of the collection of assessments by <br />installments anti in an amount equal thereto. <br />3e_etion 6. That the City Engineer be and he is hereby <br />directed to prepare and file with this Council a tentative assessment <br />showing the amount to be assessed on each lot or parcel of lead to bs <br />assessed. <br />Section ,r.
