RESOLUTION N0. 2099. <br />BY :; Mr. Crider. RESOLUTION DECLARING IT NECESSARY TO <br />Il~iPROVE PORTER ROAD FROM END OF EXISTING <br />MAIN I~TQRTHERLY TO NORTH CITY LINE. <br />WHEREAS, the owners of sixty per cent of the foot frontage of <br />property on Porter Road from the end of the existing main to the north <br />city line, have petitioned in writing for the improvement of said <br />street by constructing therein a water main. <br />NOW, THEREFORE, BE TT RESOLVED BY THE COUNCII, OF `'HE CITY OF <br />NORTH O~,NISTED, OHIO, THREE-FOUxTHS OI' Ai~L MEMBERS ELECTED THERETO <br />CONCURRING:. <br />Section 1, That it is deemed necessary and conducive to the <br />public healt~convenience and welfare that Porter Road from the end <br />of the existing main to the northerly City line, be improved by con- <br />structing therein a water main in accordance with the plans and speci- <br />fications prepared by the City Engineer. <br />Section 2. That the grade of said street shall be the grade <br />shown on the p~a~ns and specific=~tions for said improvement, which said <br />grade and a?_evations are hereby confirmed and established as the grade <br />of said street. <br />Section 3. That the plans, specifications, estimates s,nd <br />profiles of the proposed improvement heretofore prepared by the City <br />Engineer and not~1 filed in the office of the Director of Public Service <br />be, and the same are hereby approved. <br />Section That the cost of said improvement shall be <br />assessed by the oot front upon the following described lots and lands, <br />to wit, all lots and lands bounding and abutting upon the proposed im- <br />provement, which said lots and lands are hereby determined to be spec- <br />ially benefited by said improvement; and the cost of said improvement <br />shall include the expense of preliminary and other surveys, of printing <br />and publishing the notices, resolutions and ordinances required, the <br />serving of said notices, the cost of construction, together with in- <br />terest on notes or bonds issued in anticipation of collection of <br />deferred assessments and all other necessary expenditures. <br />Section 5. That the assessments so to be levied shall be <br />paid in ten annual installments, with interest not to exceed six per <br />cent per annum on deferred payments, rrovided that the owner of any <br />property assessed may, at his option, nay such assessment in cash within:. <br />thirty days from and after the passage of the assessing ordinance, in <br />which case saic? assessMent shall not include s.ny item of interest upon <br />notes or bonds to be issued in anticipation of vhe co1l.~ction of deferred <br />installments of assessment g. <br />Section 5. That notes or bonds of the City of IJorth ~Jlmsted <br />shall be issued in anticipation of the collection of assessments by <br />instal~~nents and in an amount equal thereto. <br />Section 7.
