ORDINANCE N0. ,.7 G ~, 3 <br />BY : Mr. ~e ,. ~e;eit~ ORDINANCE DETERl~iINING TO PRQCEED WITH THE <br />IMPROVEMENT OF CANTERBURY ROAD FROM LORAIN <br />ROAD TO A DRAINAGE DITCH 3000 FEET NORTHERLY <br />THEREFROM, BY CONSTRUCTING THEREIN A STORM <br />BEWEFt. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />STATE OF OHIO: <br />Section 1. That it is hereby determined to proceed with <br />the improvement of Canterbury Road from Lorain Road to a drainage ditch <br />3000 feet northerly therefrom, by constructing therein a storm sewer, <br />in accordance with Resolution No. 2021 passed September ?~ 1954, and <br />the petition of property owners described in said Resolution and in <br />accordance with the plans, specifications, estimates and profiles <br />heretofore approved and now on file in the office of the Director of <br />Public B.ervice. <br />Section 2. That all claims for damages resulting therefrom <br />shall be judicially inquired into after the completion of the proposed <br />improvement, and the solicitor be, and he is hereby authorized and <br />directed to institute proceedings in a court of competent jurisdiction <br />to inquire into such claims. <br />S.ectio That the cost of said improvement shall be- <br />assessed by t$ie oot front upon the following described lots and <br />lands, to-wit, all lots and lands bounding and abutting upon the <br />proposed improvement, which said lots and lands are hereby determined <br />to be specially benefited by said improvement; and the cost of said <br />improvement shall include the expense of preliminary and other sur- <br />veys, of printing and publishing the notices,, resolutions and ordinances <br />required, the service of said notices, the cost of construction, to- <br />gether with interest on notes or bonds issued in anticipation of <br />collection of deferred assessments and all other necessary expenditures. <br />Section !~. That the assessments so to be levied shall be <br />paid in ten annual installments, with interest not to exceed six per <br />cent per annum on deferred payments, Fro~tid~d that the owner of any <br />property assessed ma.y, at his option, pay such assessment in cash <br />within thirty days from and after the passage of the assessing ord- <br />inance, in which case said assessment shall not include any item of <br />interest upon notes or bonds to be issued in anticipation of the col- <br />lection of deferred installments of assessments. <br />Section ~. That notes or bonds of the City of North Olmsted <br />shall be issued in anticipation of the collection of assessments by <br />installments and in an amount equal thereto. <br />Section 6. That the City Engineer be and he is hereby <br />directed to prepare and file with this Council a tentative assessment <br />showing the amount to be assessed on each lot or parcel of land to be <br />assessed. <br />Sectioa,~i That the Director of Public Service be, and he <br />is hereby au-prized and directed to advertise for bids for the con- <br />struction of said improvement accord~,ng to law. <br />Section $. This ordinance is hereby declared to be an emer- <br />gency measure, the emergency being that it is necessary for the iffimed- <br />iate preservation of public health, peace, safety and welfare that this <br />ordinance be passed at once and shall take effect and be in force from <br />and after its passage. <br />PASSED:. ~ f~ ~ ! / ~ ~" <br />~-- <br />ATTEST::. „G~~~c- <br />.
