ORDINANCE N0. ~ ~,- <br />BY : Mr. „~~~~~,.,/ ORDINANCE DETERMINING TO PROCEED WITH THE <br />IMPROVEMENT OF V~,.I.ESLEY AVENUE FROM ELNlHURST <br />ROAD TO BRO%BOURNE ROAD BY CONSTRUCTING <br />THEREIN A WATER. MAIN. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />STATE OF OHIO: <br />Section 1. That it is hereby determined to proceed with <br />the improvement of Wellesley Avenue from Elmhurst Road to Broxbourne <br />Road, by constructing therein a water main, in accordance with Resolu- <br />tion No. 19$2 passed May 1$, 195l~, and the petition of property owners <br />described in said Resolution and in accordance with the plans, aped- <br />ficationa, estimates and profiles heretofore approved and now on file <br />in the office of the Director of Public Service. <br />Section 2. That all claims for damages resulting therefrom <br />shall be judicially inquired into after the completion of the proposed <br />improvement, and the solicitor be, and he is hereby authorized and <br />directed to institute proceedings in a court of competent jurisdic- <br />tion to inquire into such claims. <br />Section, That the cost of said improvement shall be <br />assessed by the foot front upon the following described lots and <br />lands, to-wit, all lots and lands bounding and abutting upon the <br />proposed improvement, which said lots and lands are hereby determined <br />to be specially benefited by said improvement; and the cost of said <br />improvement shall include the expense of preliminary and other sur- <br />veys, of printing and publishing the notices, resolutions and ordinances <br />required, the servie~ of said notices, the cost of construction, to- <br />gether with interest on notes or bonds issued in anticipation of <br />collection of deferred assessments and all other necessary expenditures. <br />Section 4. That the assessments so to be levied shall be <br />paid in ten annual installments, with interest not to exceed six per <br />cent per annum on deferred payments, provided that the owner of any <br />property assessed may, at his option, pay such assessment in cash <br />within thirty days from and after the passage of the assessing ord- <br />inance, in which case said assessment shall nat include any item of <br />interest upon notes or bonds to be issued in anticipation of the cal- <br />leetion of deferred installments of assessments. <br />Section 5. That notes or bonds of the City of North Olmsted <br />shall be iss eu d in anticipation of the collection of assessments by <br />installments and in an amount equal thereto. <br />Section 6. That the City Engineer be and he is hereby <br />directed to prepare and file with this Council a tentative assessment <br />showing the amount to be assessed on each lot or parcel of land to be <br />assessed. <br />Section 7. That the Director of Public Service be, and he <br />is hereby authorized and directed to advertise for bids for the con- <br />struction of said improvement according to law. <br />Section $.
