R E S O L U T I O N <br />No . u~ ~~ <br />'r <br />BY MR. <br />RESOLiJTION EP~FLOYING GUY R. WHEELER AS SPECIAL <br />COUNSEL TO ASSIST IN THE CONDUCT OF CERTAIN LITIGATION: <br />WHEREAS, Frost Bar, Inc., has filed its petition in the <br />Common Pleas Court of Cuyahoga County, Ohio, praying for a re- <br />straining order against the City of North Olmsted, Ohio, from the <br />enforcement of Ordinance No. 886, entitled An Ordinance Prohibit- <br />ing the Sales of Ice Creams, Ice Cream Products, Popcicles, and <br />Frozen Foods from Moving Vehicles; and <br />WHEREAS, a time for a hearing on the application for <br />temporary restraining order has been set by the Court; and <br />WHEREAS, said cause is particularly difficult for the <br />reason that it involves constitutionality of said Ordinance. <br />NOWT THEREFORE, BE IT RESOLVED, by the Council of the <br />City of North Olmsted, Ohio, that Guy R. Wheeler be, and he is <br />hereby employed as Special Counsel to assist the Solicitor of the <br />City, in the preparation and conduct of the hearing on the appli- <br />cation for temporary restraining order, in case of Frost Bar, Inc. <br />vs City of North Olmsted, Ohio. <br />For preparation for hearing for temporary restraining <br />order and for appearance in Court on same, the said Guy R. Wheeler shall <br />receive the sum of Two Hundred and No/100 0200.00) Dollars. <br />This is an emergencq measure necessary for the public health, <br />peace and safety, and to immediately provide for the employment of <br />Special Counsel to assist in conducting <br />PASSED: E.
