ORDINANCE NO. ;,~ c ~ ~ <br />BY: ,~-~--~~4~•-~-r ~~~~' ORDINANCE DETERMING TO PROCEED WITH THE <br />IMPROVEMENT OF LOUIS DRIVE ITS ENTIRE <br />LENGTH, BY CONSTRUCTING THEREIN A WATER <br />MAIN. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />STATE OF OHIO: <br />Section 1. That it is hereby determined to proceed with <br />the improvement ot~$ouis Drive its entire length, by constructing <br />therein a water main, in accordance with Resolution No. 1991 passed <br />June 15, 195, and the petition of property owners described in said <br />Resolution and in accordance with the plans, specifications, estimates <br />and profiles heretofore approved and now on file in the office of the <br />Director of Public Service. <br />Section 2. That all claims for damages resulting therefrom <br />shall be judiciary inquired into after the completion of the proposed <br />improvement, and the solicitor be, and he is hereby authorized and <br />directed to institute proceedings in a court of competent jurisdic- <br />tion to inquire into such claims. <br />Sectio~a ~ That the cost of said improvement shall be <br />assessed by th oat front upon the following described lots and <br />lands, to-wit, all lots and lands bounding and abutting upon the <br />proposed improvement, which said lots and lands are hereby determined <br />to be specially benei~ited by said improve~aeat; and the cost of said <br />improvement shall include the expense of preliminary and other sur~ya, <br />of printing and publishing the notices, resolutions and ordinances <br />required, the service of said notices, the cost of construction, to- <br />gether with. interest on notes or bonds issued in anticipation of <br />collection of deferred assessments and all other necessary expenditures. <br />Section That the assessments so to be levied shall be <br />paid in ten annua. installments, with interest not to exceed six per <br />cent per annum on deferred payments, provided that the owner of any <br />property assessed may, at his option, pay such assessment in cash <br />within thirty days from and after the passage of the assessing ord- <br />inance, in which case said assessment shall not include any item of <br />interest upon notes or bends to be issued in anticipation of the col- <br />lection of deferred installments of assessments. <br />Section 5. That notes or bonds of the City of North Olmsted <br />shall be issued in anticipation of the collection of assessments by <br />installments and in an amount equal thereto. <br />Section 6. That the City Engineer be and he is hereby <br />directed to prepare and file with this Council a tentative assessment <br />showing the amount to be assessed on each lot or parcel of land to be <br />assessed. <br />Section 7. That the Director of Public Service be, and he <br />is hereby authorized and directed to advertise for bids for the con- <br />struction of said improvement according to law. <br />Section $. This ordinance is hereby declared to be an emer- <br />gency measure, the emergency being that it is necessary for the immed- <br />iate preservation of public health, peace, safety and welfare that this <br />ordinance be passed at once and shall take effect and be in force from <br />and after its passage. <br />PASSED.: ~~ ~ ~ 1 <br />_a ., <br />ATTEST : ~ ~ -~~"~`'" <br />E.
