ORDINANCE N0. ~~` ~ ~3`~ BY : Mr. jJ,~Z~,LUf,~ ORDINANCE DETERMINING TO PROCEED WITH THE IMPROVEMENT OF ROOT ROAD FROM END OF EZTSTIIVG MAIN TO A POINT 1203 FEET NORTHERLY, BY CONSTRUCTING THEREIN A WATER MAIN. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH. OLMSTED, STATE OF OHIO: Sec~,,,,tion 1 That it is hereby determined to proceed with the improvement o~ Root Road from the end of existing main to a point 1203 feet northerly, by constructing therein a water main, in accord- ance with Resolution No. 1993, passed June 15, 195., and the petition of property owners described in said Resolution and in accordance with the plans, specifications, estimates and profiles heretofore approved and now on file in the office of the Director of Public Service. Section 2. That all claims for damages resulting therefrom shall be j~dici~-'-a~yrinquired into after the co~tpletion of the proposed improvement, and the solicitor be, and he is hereby authorized and directed to institute proceedings in a court of competent jurisdiction to inquire into such claims. Section That the cost of said improvement shall be assessed by the oot front upon the following described lots and lands, to-wit, all lots and lands bounding and abutting upon the proposed improvement, which said lots and lands are hereby determined to be specially benefited by said improvement; and the cost of said improvement shall include the expense of preliminary and other sur- veys, o~ printing and publishing the notices, resolutions and ordinances required, the ser~.ce of said notices, the cost of construction, to- gether with interest on notes or bonds issued in anticipation of collection of deferred assessments and all other necessary expenditures. Section 1~.. That the assessments so to be levied shall be paid in ten annual instal].~-ents, with interest not to exceed six per cent per annum on deferred payments, provided that the owner of any property assessed may, at his option, pay such assessment in cash within thirty days from and after the passage of the assessing ord- inance, in which case said assessment shall not include any item of interest upon notes or bonds to be issued in anticipation of the col- lection of deferred installments of assessments. Section 5. That notes or bonds of the City of North 07~,sted shall be issued in anticipation of the collection of assessments by installments and in an amount equal thereto. Section 6. That the City Engineer be and he is hereby directed to prepare and file with this Council a tentative assessment showing the amount to be assessed on each lot or ~areel of land to be assessed. Secti~„_Z. That the Director of Public Service be, and he is hereby authorize and directed to advertise for bids for the con- struction of said improvement according to law. Section ~. This ordinance is hereby declared to be an emer- gency measure,-the emergency being that it is necessary for the immedi- ate preservation of public health, peace, safety and welfare that this ordinance be passed at once and shall take effect and be in force from and after its passage.
