Whereas, by Ordinance No. 19&5 passed February 16, 195y., Council has, heretofore levied assessments for improving Barton 8oad as therein set forth and therein further provided tv pars®as assessed an opportunity for thirty daps to pay said assessments in cash, and Whereas, by reason of possible defects in the statutory notice of stssmssments, Council has caused said notice to be published for three consecutive weeks ending June ~., 195., and all other require- ments for said assessments having been duly complied with, has deter- mined to reconfirm its prior levy of such assessments without granting any further period for payment of said assessment in cash by re-euaet- ing Section 1 of said Ordinance No. 19.5 as hereinafter set forth; NOW,-THEREFOR, BE IT ORDAINED BY THE COUNCII. OF THE CITY OF NORTH OLM3TED, STATE aF OHIO: Section 1 That Section 1 of Ordinance No. 19.5 be and it is herebcfe~ and re-enacted in the following form: nSection 1. That the assessment of the cost and expense of i.mproviag Barton Boad from Lorain Road to a point l feet northerly by constructing thereim a water main, amounting in the aggregate to ~1~.~9p0.00, as reported to this Council by the City Engineer, notice of the filing of which assessment has been published, as required by law, be and the same is hereby adopted and confiraed and that there be asd is hereby levied upon all the late and loads bounding and abutting upon Barton Road from Lorain Road to a point 1100 feet northerly, by constructing therein a water main, the several amounts reported as aforesaid, which assessments, together with the descriptions of said 1Qts and lands, are ncra oa file in the office of the Clerk of this Council, and which assessments are at the rate of $6.007? per front foot and are not in excess of the special benefits to said propertg.n Secti®a 2 This ordinance is an emergency measure necessary for the pub~~ is e ah, peace, welfare and safety and to provide for the immediate levying of special assessments to raise fends for a necessary City street improvement and shall take effect and be in force from and after the earliest period allowed by law.
