Whereas, by Ordinance N®. 19t~3 passed February 16, 195., Council has heretAfore levied assessments far imFroving Bather Avenue as therein set forth and therein further Provided t® Fors®ns assessed an ®pportunity for thirty daps to pay said assessments in cash, and Whereas by reason of passible defects in the statue®ry notice of assessments, Ce~uncil has caused said notice to bs Published for three consecutive weeks ending dune ~. 195, and all other require- ments far said assessments having been du~.y complied with, has deter- mined to reconfirm its prior levy of such assessments with®ut.:~grantng any further Period for payment of said assessment in cash by re-enact- ing Section 1 of said Ordinance N®. 1943 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED B'Y THE COUNCIL OF THE CITY OF NORTH OLMSTED, STATE OF OHIO: Section 1 That Section 1 ®f Ordinance No. 19.3 be and it is hAre~p ame and re-enacted in the following form: e~Section 1. That the assessment of the cost and expense of improving gather Avenue from the end of the existing water main to the easterly City lies, by eoastructing therein a water main, am©unting in the aggregate to $3,900.00 as reported to this Council by the City ~ginser, notice of the fil~ng of which assessment has been published, as required by lax, be and the same i$ hereby adopted and c®nfirmed and that there be and is hereby levied upn all the lots and lands bounding and abutting upon Esther Avenue from the end of the existing xater main t© the easterly City line, ~ constructing therein a water main, the several amounts reported as aforesaid, which assessments, together with the descriptions of said lots and lands, are now on file ia~ the office of the Clerk of this Council, aid xhich assessments are at the rate of ~t,..3772 per front foot and are nat in excess of the special benefits to said property." Section 2 This ordinance is an emergency measure necessary for the publ~ea~th, peace, welfare and safety and to provide for the immediate levying of special assessments to raise funds for a necessary City street improvement and shall take effect and be in force from and after the earliest period alloxed by law..
