r ORDIT~IANCE NO. ,r~l ~ ~~ <br />BY: ~'~~ ~` ~-~'~ ORDIT~iANCE DET1iJRMINING TU PrtOCEED WITH <br />THE IMPROVEI~IEI~iT OFCANTERBURY ROAD (N0. 2j <br />r'ROM NORTH LINE Or COE RIDGE TNVESTi41'~'NT <br />COMPANY TO NORTHERLY CITY LINE, BY <br />COTJSTRUCTING THEREIN A WATER MAIN. <br />BE IT ORDAIIJED BY `'HE COUT~CL OF THE CITY OF NORTIi OLMSTED, <br />STATE OF OHIO: <br />Section l That it is hereby determined to proceed with the <br />improvement of~terbury Road (No. 2) from north line of Coe Ridge <br />Investment Company to northerly City line, by constructing therein a <br />water main, in accordance with Resolution No. 1g0~. passed July 7, 1953, <br />and the petition of property owners described in said Resolution and in <br />accordance with the plans, specifications, estimates and profiles here- <br />tofore approved and now on file in the office of the Director of Public <br />Service. <br />Section 2. That all claims for damages resulting therefrom <br />shall be judicially inquired into after the completion of the proposed <br />improvement, and the solicitor be, and he is hereby authorized and <br />directed to institute proceedings in a court of competent jurisdic- <br />tion to inquire into such claims. <br />Section 3. That the cost of said improvement shall be assessed <br />by the foot-front upon the following described lots and lands, to wit, <br />all lots and lands bounding and abutting upon the proposed improvement, <br />which said lots and lands are hereby determined to be specially bene- <br />fited by said improvement; and the cost of said improvement shall in- <br />clude the expense of preliminary and other surveys, of printing and <br />publishing the notices, resolutions and ordinances required, the serv- <br />ing of said notices, the cost of construction, together with interest <br />on notes or bonds issued in anticipation of collection of deferred <br />assessments and all other necessary expenditures. <br />Section la.. That the assessments so to be levied shall be paid <br />in ten annual installments, with interest not to exceed six per cent <br />per annum on deferred payments, provided that the owner of any pro- <br />perty assessed may, at his option, pay such assessment in cash within <br />thirty days from and after the passage of the assessing ordinance, in <br />which case said assessment shall not include any item of interest upon <br />notes or bonds to be issued in anticipation of the collection of de- <br />ferred installments of assessments. <br />Section 5, That notes or bonds of the City of Tdorth Olms~'ed <br />shall be issued in ant~:eipation of the collection of assessments by <br />installments and in an amount equal thereto. <br />Section 6. That the City Engineer be and he is hereby directed <br />to prepare and file with this Council a tentative assessment showing <br />the amount to be assessed on each-lot or parcel of land to be assessed. <br />Section 7. That the Director of Public Service be, and he is <br />hereby authorized and directed to advertise for bids for the construc- <br />Lion of said improvement according to law. <br />Section $.
