That it is hereby determined to proceed with the im- <br />s, rovement of Lucydale Avenue from northerly line of Sublot Ido. 40 to <br />_ Kennedy Ridge.., by grading and slagging same, in accordance with Reso- <br />lution No. 1$76 passed February 2ta., 1953, and the petition of property <br />owners described in said Resolution and in accordance with the plans, <br />specifications, estimates and.profiles heretofore approved and now <br />on file in the office of the Director of Public Service. <br />Section 2, That all claims for damages resulting therefrom <br />shall be :judicially inquired into after the completion of the pro- <br />posed improvement, and the solicitor be, and he is hereby authorized <br />and directed to institute proceedings in a court of competent juris- <br />diction to inquire into such claims. <br />Section 3. `What the cost of said improvement shall be as- <br />sessed by the foot front upon the following described lots and lands, <br />to wit, all lots and lands bounding and abutting upon the proposed <br />improvement, which said lots and lands are here'oy determined to be <br />specially benefited by said improvement; and the cost of said im- <br />provement shall include the expense of preliminary and other surveys, <br />of printing and publishing the notices, resolutions and ordinances re- <br />quired, the serving of said notices, the cost of construction, to- <br />gether with interest on notes or bands issued in anticipation of col- <br />lection of deferred assessments and all other necessary expenditures. <br />Section 1,.. That the assessments so to be levied shall be paid <br />in five annual installments, with interest not to exceed six per cent <br />per annum on deferred payments, provided that the owner of any pro- <br />perty assessed may, at his option, pay such assessment in cash within <br />thirty days from and after the passage of the assessing ordinance, in <br />which case said assessment shall not include any item of interest upon <br />notes or bonds to be issued in anticipation of the collection of <br />deferred installments of assessments. <br />Section 5. That notes or bonds of the City of North Olmsted <br />shall be issued in anticipation of the collection of assessments by <br />installments and in an amount equal thereto. <br />Section 6. That the City Engineer be and he is hereby directed <br />to prepare and file with this Council a tentative assessment showing <br />the amount to be assessed on each lot or parcel of land to be assessed. <br />Section 7. That the Director of Public Service be, and he is <br />hereby authorised and directed to advertise for bids for the construc- <br />tion of said improvement according to law. <br />Section $. This ordinance is hereby declared to be an emer- <br />gency measure,-the emergency being that it is necessary for the immedi- <br />ate preservation of public health, peace, safety and welfare and to <br />provide for immediately proceeding with the necessary improvement of <br />a City street that this ordinance be passed at once and shall take <br />effect and be in force from and after its passage. <br />PASS:r;D: APRIL 7 1953 <br />ATTES'1' : <br />_.- <br />E.
