ROAD - FR,OT~. <br />COLUT~IBIA ROAD TO WALTER ROAD , BY <br />CONSTRUCTING THEREIN A WATER MAIN. <br />BE IT ORDAINED BY THE COUNCIL Or' 'fHE CITY OF T~tORTH OLI~STED , <br />STATE OF OHIO: <br />Section 1. That it is hereby determined to proceed with the im- <br />provement of Gessner Road from Walter Raad to Columbia Road, by construct- <br />ing therein a water main, in accordance with Resolution No. 1$74 passed <br />February 3, 1953, and the petition of property owners described in <br />said Resolution and in accordance with the plans, specifications, esti- <br />mates and profiles heretofore approved and now on file in the office <br />of the Director of Public Service. <br />Section 2. That all claims for damages resulting therefrom shall <br />be judicially inquired into after the completion of the proposed im- <br />provement, and the solicitor be, and he is hereby authorized and direct- <br />ed to institute proceedings in a court of competent jurisdiction to <br />inquire into such claims. <br />Section 3. That the cost of said improvement shall be assessed <br />by the foot front upon the following ciescribedlnts and lands, to wit, <br />all lots and lands bounding and abutting upon the proposed improvement, <br />which said lots and lands are hereby determined to be specially bene- <br />fited by said improvement; and the cost of said improvement shall in- <br />clude the expense of preliminary and other surveys, of printing and <br />publishing the notices, resolutions and ordinances required, the serv- <br />ing of said notices, the cost of construction, together with interest <br />on notes or bonds issued in anticipation of collection of deferred <br />assessments and all other necessary expenditures. <br />Section 4. That the assessments so to be levied shall be paid <br />in ten annual installments, with interest not to exceed six per cent <br />per annum on deferred payments, provided that the owner of any pro- <br />perty assessed may, at his option, pay such assessment in cash within <br />thirty days from and after the passage of the assessing ordinance, in <br />which case said assessment shall not include any item of interest upon <br />notes or bonds to be issued in anticipation of the collection of <br />deferred installments of assessments. <br />Section 5. That notes or bonds of the City of North Olmsted <br />shall be issued in anticipation of the collection of assessments by <br />installments and in are amount equal thereto. <br />Section 6. That the City ~;ngineer be and he is hereby directed <br />to prepare and file with this Council a tentative assessment showing <br />the amount to be assessed an each lot ar parcel of land to be assessed. <br />Section 7. That the Lirector of Public Service be, and he is <br />hereby authorized and directed to advertise for bids for the construc- <br />tion of said improvement according to law. <br />Section b.
