<br />passed except by an affirmative vote of not less than two--thirds of the full
<br />membership of Council. In considering such proposed amendment, supplement or
<br />change, the P~.anning Commission shall give weight to any protest presented, duly
<br />signed by the owners of twenty (20) per cent or more either of the area of the
<br />lots included in such proposed change or of those owners of property within a
<br />radius of 500 feet of the property in question.
<br />(c) Council shall take final action upon such proposed amendment, supple-~
<br />went or change within forty-five (45) days after the fi73.ng of petition for same
<br />with the Clerk of Council, and if Council shall fail to take action upon such pe-
<br />tition within said time the petition shall be deemed to have been re3ected.
<br />ARTICLE XVI
<br />VALIDITY
<br />Section 1. VALIDITY. If any section, clause, provision or portion of this
<br />ordinance shall be held to be invalid or unconstitutional by any court of coaspe-
<br />tent 3urisdiction, such holding shall not affect or impair any other section,
<br />clause, provision or portion of the ordinance.

<br />contrary hereto, be and the same are hereby repealed.
<br />This is an emergency measure necessary for the public health, peace and
<br />safety, and to provide an adequate and proper Zoning Ordinance for the City of
<br />North Olmsted, Ohio.
