ORDINANCE N0. ~ q ~~~ ORDINANCE DETERNiINIi~G TO PROCEED WITH BY : ~~~ THE Il+~PRO~NiENT OF BAILEY ROAD} FRC~I LORAIN ROAD TO SOUTHERLY E~ID , BY CONSTRUCTING THEREIN A WATER NiAI~T BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OL~+ISTED , STATE OF OHIO: Section 1 That it is hereby determined to proceed with the im- provement o ailey Road from Lorain Road to southerly end, by construct- ing therein a water main, in accordance with Resolution No. 1$x.9 passed September 2, 1952, and the petition of property owners described in said Resolution and in accordance with the plans, specifications esti- mates and profiles heretofore approved and now on file in the of~'ice of the Director of Public Service. Section 2. That all claims for damages resulting theref shall be judicially inquired into after the completion of the proposed im- provement, and the solicitor be, and he is hereby authorized and direct- ed to institute proceedings in a court of competent jurisdiction to inquire into such claims. Section~~ That the cost of said improvement shall be assessed by the foot front upon the following described lilts and lands, to wit, all lots and .lands bounding and abutting upon the proposed improvement, which said lots and lands are hereby determined to be specially bene- fited by said improvement; and the cost of said improvement shall in- clude the expense of preliminary and other surveys, of printing and publishing the notices, resolutions and ordinances required, the serv- ing of said notices, the cost of construction, together with interest on notes or bonds issued in anticipation of collection of deferred assessments and all other necessary expenditures. Section ~+. That the assessments so to be levied shall be paid in ten annual installments, with interest not to exceed six per cent per annum on deferred payments, provided that the owner of any pro- perty assessed may, at his option, pay such assessment in cash within thirty days from and after the passage of the assessing ordinance, in which case said assessment shall not include any item of interest upon notes or bonds to be issued in anticipation of the collection of deferred installments of assessments. Section 5. That notes or bonds of the City of North. Olmsted shall be issued in anticipation of the collection of assessments by installments and in an amount equal thereto. Section 6. That the City Engineer be and he is hereby directed to prepare and file with this Council a tentative assessment showing the amount to be assessed on each lot or parcel of land to be assessed. Section 7. That the Director of Public Service be, and he is hereby authorized and directed to advertise for bids for the construc- tion of said improvement according to law. Section $. This ordinance is hereby declared to be an emer- gency measure, the emergency being that it is Necessary for the imanedi- ate preservation of public health, peace, safety and welfare that this ordinance be passed at once and shall take effect and be in force from and after its passage.
