ORD IRAN CE NO . 9 q J BY: ~%~~~ ORDINAN CE DETERMINING TO PH.OCEED WITH THE IMPROYII~IENT OF STEARNS ROAD -FROM END OF EXISTING MAIN TO SOt3THEF.LY CITY LINE, BY CONSTRUCTING THEREIN A WATER MAIN. BE IT ORDAINED EY THE COUT~iCIL OF THE CITY OF NORTH OLMSTED, STATE OF OHIO:. . Section 1. That it is hereby determined to proceed with 'the im- provement of Stearns Road from end of existing main to southerly City line, by constructing therein a water main, in accordance with Resolu- tion No. 1$50 passed September 2, 1952, and the petition of property owners described in said Resolution and in accordance with the plans, specifications, estimates and profiles heretofore approved and now on file in the office of the Director of Public Service. Section 2. That all claims for damages resulting therefrom shall be judicially ,,inquired into after the completion of the proposed improvement, and the solicitor be, and he is hereby authorized and directed to institute proceedings ~.n a court of competent jurisdic- tion to inquire into such claims. Section 3. That the cost of said improvement shall be assessed by the foot front upon the following described lots and lands,. to wit, all lots and lands bounding and abutting. upon the proposed improvement, which said lots and lands are hereby determined to be specially bene- fited by said i~gprovement; and the cost of said improvement shall in- clude the expense of preliminary and other surveys, of printing and publishing the notices, resolutions and ordinances regtaired, the serv- ing of said notices, the cost of construction, together with interest on notes or bonds issued in anticipation of collection of deferred assessffients and alI other necessary expenditures. Section 1,.. That the assessments so to be levied shall be paid in ten annual installments, with interest not to exceed six per cent per annum on deferred payments, provid¢d that the owner of any pro- perty assessed may, at his option, pay such assessment in cash within thirty days from and after the passage of the assessing ordinance, in which case said assessment shall not include any item of interest upon notes or bonds to be issued in anticipation of the collection of deferred installments of assessments. Section 5. That notes or bonds of the City of 1~orth Olmsted shall be issued in anticipation of the collection of assessments by installments and in an amount equal thereto. Section 6. That the City 'Engineer be and he is hereby directed to prepare and file with this Council a tentative assessz~ent showing the amount to be assessed on each lot or parcel of land to be assessed. Section 7. That the Director of Public Service be, and he is s~ hereby authorized and directed to advertise for bids for the ccanstruc- tion of said improvement according to law. Section $. This ordinance is hereby declared to be an emer- gency measure, the emergency being that it is necessary for the immedi- ate preservation of public health, peace, safety and welfare that this ordinance be passed at once and shall take effect and be in force from and after its passage.
