ORD IRAN CE NO . 9 q J <br />BY: ~%~~~ ORDINAN CE DETERMINING TO PH.OCEED WITH <br />THE IMPROYII~IENT OF STEARNS ROAD -FROM <br />END OF EXISTING MAIN TO SOt3THEF.LY CITY <br />LINE, BY CONSTRUCTING THEREIN A WATER <br />MAIN. <br />BE IT ORDAINED EY THE COUT~iCIL OF THE CITY OF NORTH OLMSTED, <br />STATE OF OHIO:. . <br />Section 1. That it is hereby determined to proceed with 'the im- <br />provement of Stearns Road from end of existing main to southerly City <br />line, by constructing therein a water main, in accordance with Resolu- <br />tion No. 1$50 passed September 2, 1952, and the petition of property <br />owners described in said Resolution and in accordance with the plans, <br />specifications, estimates and profiles heretofore approved and now on <br />file in the office of the Director of Public Service. <br />Section 2. That all claims for damages resulting therefrom <br />shall be judicially ,,inquired into after the completion of the proposed <br />improvement, and the solicitor be, and he is hereby authorized and <br />directed to institute proceedings ~.n a court of competent jurisdic- <br />tion to inquire into such claims. <br />Section 3. That the cost of said improvement shall be assessed <br />by the foot front upon the following described lots and lands,. to wit, <br />all lots and lands bounding and abutting. upon the proposed improvement, <br />which said lots and lands are hereby determined to be specially bene- <br />fited by said i~gprovement; and the cost of said improvement shall in- <br />clude the expense of preliminary and other surveys, of printing and <br />publishing the notices, resolutions and ordinances regtaired, the serv- <br />ing of said notices, the cost of construction, together with interest <br />on notes or bonds issued in anticipation of collection of deferred <br />assessffients and alI other necessary expenditures. <br />Section 1,.. That the assessments so to be levied shall be paid <br />in ten annual installments, with interest not to exceed six per cent <br />per annum on deferred payments, provid¢d that the owner of any pro- <br />perty assessed may, at his option, pay such assessment in cash within <br />thirty days from and after the passage of the assessing ordinance, in <br />which case said assessment shall not include any item of interest upon <br />notes or bonds to be issued in anticipation of the collection of <br />deferred installments of assessments. <br />Section 5. That notes or bonds of the City of 1~orth Olmsted <br />shall be issued in anticipation of the collection of assessments by <br />installments and in an amount equal thereto. <br />Section 6. That the City 'Engineer be and he is hereby directed <br />to prepare and file with this Council a tentative assessz~ent showing <br />the amount to be assessed on each lot or parcel of land to be assessed. <br />Section 7. That the Director of Public Service be, and he is <br />s~ hereby authorized and directed to advertise for bids for the ccanstruc- <br />tion of said improvement according to law. <br />Section $.
