ORD I NAi~ CE N0 . <br />BY: ~/~i.wwu-o~ <br />9~y <br />AN ORDINANCE REQUIRING DEPOSIT <br />FOR THE REPAIR OR REPLA CEI~iENT <br />OF SIDEWALKS <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OT.,~ISTED , <br />OHIO: that <br />No person, firm or corporation shall obtain a permit to <br />build, erect or construct any building, structure or edifice with- <br />out first having deposited with the Building Commissioner of the <br />City a sum of money sufficient to repair or replace any City side- <br />walks damaged by the hauling or the moving of material or equipment <br />over such sidewalks. <br />No person, firm or corporation shall haul or move over the <br />sidewalks of the City any material or equipment without first having; <br />deposited with the Building Commissioner of the City a sum of money <br />sufficient to repair or replace such sidewalks as may be damaged <br />thereby. <br />The Building Commissioner shall demand and shall receive <br />the amount of deposit herein required and such deposit shall be based <br />on the cost per square foot for such repair or replacement, which <br />shall be multiplied by the number of square feet of sidewalk which <br />may be damaged. <br />The Building Commissioner shall, on the completion of any <br />building or structure, make an examination of th$ sidewalk adjacent <br />to such premises and, if damaged, turn aver to the Treasurer of the <br />City money on deposit which shall be used to repair or replace said <br />sidewalk. <br />The Council upon the completion of such repairs or replace- <br />merits shall order any balance remaining in said deposit returned to <br />the lawful owner . <br />The Building Commissioner shall return the whole of said <br />deposit to the lawful owner thereof if no damage has been sus- <br />tained by the City. <br /> <br />
