r <br />ORDINANCE N0. y ,~ 7 <br />BY: AN flRDIN'ANCE TO LEVY SPECIAL <br />ASSESSI~tTS FOR THE IMPRCV'EI'~ENT <br />OF ~EACKENZIE ROAD FROM THE <br />SOUTHERLY LINE OF JOHN AND MAxY <br />MAR.USCHAK TO NORTHERLY LINE OF <br />GRACE D . ~~IASON . <br />BE IT ORDAINED BY THE COUNCIL OF `THE CITY OF NORTH QLA~ST , ODIC? <br />Section 1. That the assessment of the cost and expense of im?~roving <br />Mackenzie Road, from the southerly line of John and Mary Maruschak~s <br />property to northerly line of Grace D. Mason's property by the <br />construction of a water main, amounts in the aggregate to 26,J.~00.00, <br />as reported to this Council by the City Engineer, notice of the <br />filing of which assessment has been given, as required by law, be <br />and the same is hereby adopted and confirmed and that there be and <br />is hereby levied upon all of the lots and Iand bounding and abutting <br />upon Mackenzie Road, from the southerly line of John and Mary <br />Maruscha~!s property to northerly line of Grace D. Mason's property, <br />the several amounts reported as aforesaid, which assessments, to- <br />gether with the descriptions of said lots and lands, are now on file in <br />the office of the clerk of this Council, and which assessments are at <br />the rate of X5.0921 per front foot and are not in excess of the <br />special benefits to said property. <br />Section 2. That the total assessments against each lot or parcel <br />of land shall be payable in cash within thirty days from and after <br />the passage of this ordinance, or at the option cf the owners, in <br />ten annual installments with interest at the same rata as shall be <br />borne by the bonds to be issued in anticipation of the collection <br />of the same. All cash payments shall be made to the Treasurer of <br />said City. A11 assessments and installments thereof remaining <br />unpaid at the expiration of said thirty days shall be certified <br />by the Clerk of this Council to the County Auditor, as provided by <br />law, to be by him placed. on the tax duplicate and collected as <br />other taxes are collectted. <br />Section 3. This ordinance shall take effect and be in force from <br />and after the earliest period allowed by law. <br />PASSED: December a ~ 1951 <br />
