' ORDINANCE N0. <br />BY: <br />~ ~ ~ <br />AN ORDIATANCE TO LEVY SPECIAL <br />ASSESSMENTS FOR THE 7PRQ~II~ENT <br />OF McKENZIE ROAD, FROM LORAIN <br />ROAD TO THE SOUTHERLY LIME OF <br />JOHN & MARY MARUSC~IAK PROPERTY <br />BY THE CONSTRUCTION OF A WATER <br />MAIN. <br />BE IT ORDAINED BY THE COUNCIL Off' THE CITY' OF NORTH OLMSTED, OHIO: <br />Section i. That the assessment of the cost and expense of improving <br />McKenzie Road, from Lorain Road to the southerly line of John and <br />Mary Maruschak~s property by the construction of a water main, <br />amounts in the aggregate to X25,600.00, as reported to this Council <br />by the City Engineer, notice of the filing of which assessment has <br />been given, as required by law, be and the same is hereby adopted <br />and confirmed and that there be and is hereby levied upon all of <br />the lots and land bounding and abutting upon McKenzie Road, from <br />Lorain Road to the southerly line of John and Mary Maruschakts <br />property, the several amounts reported as aforesaid, Tst~iiCh <br />assessments, together with the descriptions of said lots said la~ds~, <br />are now on filet in the office of the Clerk of this Council, and <br />which assessments are at the rate of X5.3696 per front foot and <br />are not in excess of the special benefits to said property. <br />Section 2. That the total assessments against each lot or parcel <br />of land shall ~ payable in cash within thirty days from and after <br />the passage of this ordinance, or at the option of the owners, in <br />ten annual installments with interest at the same rate as shall be <br />borne by the bonds to be issued in anticipation of the collection <br />of the same. All cash payments shall be made to the Treasurer of <br />said City. All assessments and installments thereof remaining <br />'' unpaid at the expiration of said thirty days shall be certified <br />by the Clerk of this Council to the County Auditor, as provided by <br />law, to be by him placed on the tax duplicate and collected as <br />other taxes are collected. <br />Section 3. This ordinance shall take effect and be in force from <br />and after the earliest period allowed by law. <br />PASSED : December ~ ~ 1951 <br />
