That it is hereby determined to proceed with the <br />improvement of Canterbury H.oad, From Lorain road - 1Vorth to the northerly <br />Line of the Coe Ridge Investment Co. 2!+49,05 .Feet frog Lorain, by constxuct- <br />ing therein a water main, in accordance wn.th Resolution i~a. 1757 passed on <br />the 3rd day of July, 1951, and the petit ion of the property owners described <br />in said :desolation and in accordance with the plans specifications,. esti- <br />mates and prof ilea heretofore approved and now on f~le in the office of the <br />Clerk, <br />Section 2, `t'hat all claims for damages, resulting therefrom shall <br />be judicially inquired into after the completion of the proposed i~-prove- <br />ment, and the solicitor be, and he is hereby authorised at~d directed tc <br />institute proceedings in a court of competent jurisdiction to inquire into <br />such claims. <br />Section 3. That the cost of said improvement shall be assessed <br />by the foot front upon. the following described lots and. lams, to wit,. all <br />lots and lands, bounding and abutting upon the proposed 3.mprcave~sent, ro~xich <br />said lots and lands are hereby determined to be specially benefited by <br />said improvement; and the cost of said improv®ment shall include the expense <br />of preliminary and other surveys of printing and publishing the notices <br />resolutions and ardinaaces required, the serving of said notices, the cQSt <br />of cvra~tructimr~, together xith int-erect on notes or bonds i.~sued in antci- <br />patoa of collection of deferred assessments and all other necessary ex- <br />pend.iture s. <br />Section 4. 2`hat the assessffients so to be levied shall be paid <br />in ten annual stallments, with interest not to exceed six per cent per <br />arum on deferred payments, provided., that the owner of any property <br />assessed may, at his option, pay such asses~;ent in cash within thirty <br />days from and after the passage of the assessing ordinance, in which case <br />said assessment shall not include any its of interest upon notes or bonds <br />to be issued in anticipation of the collection of deferred installments of <br />assessments. <br />Section 5• That notes ar bonds of the uillage of lvorth Olmsted <br />shall be issued i.n anticipation of the. collection of assessments by <br />installments and in an amount equal thereto. <br />Section 6. `shat the village Engineer be and he is hereby <br />directed to prepare and file with this council a tentative asssssa~ent show- <br />ing the amount to be assessed on each lot or parcel of land to be assessed. <br />Section 7'. `t'hat the Clerk be, and he is hereby authorised and <br />directed to advertise for bids for the construction of staid 3.mprarvement <br />according to law. <br />Section ~.
