CITY OF NORTH OLMSTED ORDINANCE No. 63 ~~ ,~~ AN ORDINANCE DETERMINING TO PROCEED WITH THE I1~tFROVE- MENT OF NORTH PARK DRIVE IN THE CITY OF NORTH OLM5T~, OHIO, BY INSTALLING AND CONSTRUCTING THfiREIN A TNiELVE INCH 1~ATER MAIN FROM THE INTERSECTION OF PORTER ROAD AND NORTH PARK Z7RIVE T4 A POINT THIRTEF,SN HUNDRED (1344) FEET WEST OF SATD INTERSECTION, AND DECLARING AN EMERGENCY. BB IT ORDAINBD by the Council of the City of North Olmsted, Mate. of Ohio; Section 1; That it is hereby determined to proEeed with the improvement in the City of North Olmsted, Ohio, in North Park Drive from its intersection with Porter Road to a point 1340 feet west thereof. Section 2: That•sad improvement shall be made in accordance with the provisions of Resolution No. 63-168 pa~csed August 13, 1963, and with the plans, specifications, e,~timate~s and profiles heretofore approved and now on file in the office of the Clerk of this Council, by installing and constructing therein a twelve (12) inch water main. Section 3; That all claims for damages resulting there- from that have been legally filed shall be inquired into before the commencement of the proposed improvement, and the Director of Law is hereby authorised and directed to institute legal proceedings in a Court of competent jurisdiction to inquire into claims that have been so filed. Section 4: That the Cityt$ portion of the cost of said improvement shall be increased to the extent shown in Resolution No. b3-235 which is a Resolution approving the report of the Assessment Esquaiization Board hereinafter referred to, and the remaining portion of the cost provided in the above mentioned Resolution of Necessity to be assessed shall be assessed in the manner and the number of installments provided in said Resolution and on the lots and lands described thereon.
