CITY OF NORTH OLMSTED <br />ORDINANCE No. 63 - ~ <br />/_ ! <br />AN ORDINANCE RI~QUIRING A RBFERENCE BY THB BUILDING <br />COMMISSIONER OP AN APPLICATION FOR A H~JILDIIWG PER- <br />'~~ A+tIT iN CURTAIN CASES TO THS BG?ARD OF &JILDING CODS <br />APPEALS , AND DBCLAR I NG AN BMSRGE~iC'Y. <br />BE IT ORDAIAtED by the Council of the City of <br />North Olmsted, State of Qhios <br />Section 1: That when the Huilding Administrator re- <br />ceives an application fora permit to construct, alter or add <br />to any ~structtsre 4r to move any already existing structure <br />from one site to another and he finds that the structure <br />prop©sed to be constructed, altered, added to or moved to s <br />new site would be of such design, material or 1c~caton ss to <br />substantially impair the waiue of neighboring pr©pert3.ea, <br />fail to conform to the erstabiished pattern of development <br />of the area or be Cketrimer-tal to the general welfare and <br />future gr~rth of the cety, he shad, within ten (l~) days <br />of rtEeipt of such application refer the same to the Bawd <br />of Building Code Appeals for a decision as t o whether or <br />not such permit sha31 be issued. <br />Section ~~ That the Hoard of Building Code Appealffi <br />shall, within thirty (30) days after the reference of arch <br />application, hold a public meeting thereon, of which hearing <br />at least ten (10) days notice shall be given by pubiiaateon <br />in a newspaper of general circulation in the municipality. <br />The Board of Building Cade Appeals shall, not later than <br />fifteen C15) days after such public hearing, determent <br />whether the permit so applied for shall be issued or rejected. <br />Wretten notice of the determination by the Board of Building <br />Code Appeals shall be given by first class mail to the applic- <br />ant by the Building Administrator within five (~) days following <br />the decision of the Board. <br />Section 3t That the Hoard, en deciding whether or <br />not a permit a~hali be issued in such cases, shall consider: <br />(a) Whether or not the structure proposed to be <br />constructed, altered, added to or moved from <br />another site is of such design, material or <br />location as to substantially impair the value <br />of neighboring properness; and <br />(b) Whether or not such structure conforms to the <br />already estableshed pattern of development <br />in the area; and <br />(c) Whether or not it is detrimental to the general <br />welfare and future growth of the city, and <br />(d) Whether the rejection of the application for a <br />permit would unreasonably empede the ntarmal <br />development of the property for which the per- <br />n~it is sought. <br />
