WHEREAS, Millkap, Inc., developers of North Park Bstates Subdivision, has heretofore filed, with the Council's approval, its plot plan and its improvement plans; and HHERBAS, within the limits of said subdivisioa the storm drainage systeh is to be installed in conformance to said improvement plans by the developer; and WHER$AS, the developer has offered to furnish all of the materia3 necessary t® culvert the open ntbrR drainagt ditch which services said subdivision begoacl the liaits said subdivision in a geaerai easterly and ec~ewha,t northerly d~.rection as far as the rear lot (east line) of the parcel of land owned by Janes E. and Laura Cooke, all as shown on the C}ff-Site StQSm Drainage Imprmvent Plan attached hereto and incorporated herein by reference; and WHBREAS, the City Engineer has approved said pleas and Council has d+~termined that it is necessary for the preserva- tion of the public health, safety and welfare that the off-site culverting of said open storm drainage ditch be installed by the City and that the City uadev~.ak~ t0 acquire any aaseeentffi found to be necessary to the completion of said project. Nom, THEDtBPORE, BB IT E~DAINED by the Council of the City of North Olmsted, estate of E~hio: Section is That the Director of Public Service be and he is hereby authorized to culvert the existing open storm drainage ditch and re-locate some portions of the same from Lansing Drive easterly and somewhat northerly to the rear or east line of a parcel of land owned by James B. and Laura Cooke on Martin Drive (from Station 0+00 to Station 14+46 ). in the manner and as is shown in detail on the Off-Site Stara Drainage Improvement Plan for Suburban Planners dated September, 1~~3, which is attached hereto and incorporated herein by reference; that this culvertng be done by the City at its oMn expense but only provided that the developer, Miilkap, Inc., developer of North Park Estates Subdi~-sion, furnish and deliver to the site of installation all of the material needed to co~-pl~te said culverting, and provided, further, that such developer perform, at its e~cpense, ail construction in connection with lowering the water maims where such culvert crosses Lansing Drive and Martin ~3rve.
